Scottish Parliament (Recall of Members) Bill

Graham Simpson MSP introduced this Member’s Bill. It will introduce new processes for removing MSPs from office.

Prior to the conclusion of Stage 3 amendment proceedings on 24 February 2026, the Bill was referred to as the Scottish Parliament (Recall and Removal of Members) Bill.

Overview

The Bill as introduced sets out that an MSP could be recalled:

  • if they receive a sanction excluding them from Parliament for a certain period of time
  • if they receive a prison sentence of less than 6 months. 

When an MSP is recalled, people in the constituency or region that the MSP represents will be able to sign a petition calling for the MSP to lose their seat. If the petition is successful, the MSP will lose their seat.

The Bill also establishes that an MSP could be removed if:

  • they receive a prison sentence of 6 months to 1 year (at the moment an MSP is only removed if they receive a prison sentence of more than 1 year)
  • they do not attend Parliament in person for 6 months and do not have a good reason for their non-attendance.

Why the Bill was created

Graham Simpson MSP believes that the current circumstances where an MSP can be removed from office are too limited.

The Bill was introduced on 17 December 2024

Stage 1: general principles

At Stage 1, the Bill is given to a lead committee. This is usually the committee whose remit most closely relates to the subject of the Bill. The lead committee will consider and report on the Bill. Other committees may also examine the Bill and report to the lead committee. Finally, there is a debate and vote by all MSPs on the general principles of the Bill. If the general principles are not agreed to, then the Bill ‘falls’ and can’t become law.

Timetable for Stage 1

Stage 1 Deadline

On 14 May 2025, Parliament agreed motion S6M-17532, that consideration of the Scottish Parliament (Recall and Removal of Members) Bill at Stage 1 be completed by 7 November 2025.

On 30 October 2025, Parliament agreed motion S6M-19442, that consideration of the Scottish Parliament (Recall and Removal of Members) Bill at Stage 1 be extended to 14 November 2025.

Parliament agreed the general principles of the Bill

The Bill ended Stage 1 on 13 November 2025

Stage 2: changes to the Bill

At Stage 2, MSPs can propose changes to a Bill. These are called 'amendments'. Any MSP can suggest amendments but only members of the Stage 2 committee can decide on them.

At Introduction, the Presiding Officer decided under Rule 9.12 of Standing Orders that a financial resolution is required for this Bill.
