The Bathing Waters (Scotland) Regulations 2008 Reg 4 states Scottish Ministers and the Scottish Environment Protection Agency (SEPA) must exercise their relevant functions so as to take such realistic and proportionate measures as they consider appropriate with a view to increasing the number of bathing waters classified as “good” or “excellent”. However, there is no obligation to take measures which would result in disproportionate expense or where any change in classification is infeasible.

Following significant investment and improvements in the first two cycles of river basin management planning, 98% of Scotland’s designated bathing waters now meet ‘sufficient’ or better environmental water quality standards, and more bathing waters are now rated as ‘excellent’ than ever before.

During the third cycle we continue to apply measures to protect bathing waters aiming to achieve further good or excellent classifications, avoiding deterioration and implementing plans to ensure that the health of bathers at designated sites is protected”. SEPA will continue with a focused approach in diffuse pollution priority catchments to drive compliance with environmental legislation to help achieve water quality objectives and improve bathing water quality.

The Scottish Environment Protection Agency is responsible for monitoring, classifying, protecting and improving designated bathing waters with aim to reduce the risks to human health, where a large number of people bathe, by protecting and improving bathing water quality. SEPA monitors and classifies bathing waters on an annual basis following strict EU standards and publishes the results on its’ website. Bathing Waters : Summary of last season (sepa.org.uk) .

The Bathing Water (Scotland) Regulations 2008 Reg11(4) requires that for bathing waters classified as poor SEPA must take such action as it considers necessary, whether in relation to the regulation of any controlled activity or under any other functions to ensure that the bathing water can be classified as “sufficient”, “good” or “excellent”, unless permanent advice against bathing has been issued.

The following table shows that the number of bathing waters designated as good and excellent has steadily increased in the past three years.

As set out at Section 2.38 of the Ministerial code Ministers must not divulge either who provided the advice or its contents (whether it is from the Law Officers or from anyone else). This applies to all forms of legal advice, including advice on a particular subject or advice associated with clearance of a document.

As this is an operational matter for Scottish Water [and this data is not held by Scottish Government] I have asked them to respond. Their reply is as follows:

In respect of published guidelines on reporting, Scottish Water is not currently required to report the number of days for which overflow event monitoring is unavailable. Overflow events are calculated in January using available telemetry data downloaded throughout the year.

As part of Scottish Water’s annual reporting of overflow events, a lack of data available would be noted within the commentary along with any additional explanatory information.

As outlined within Scottish Water’s Improving Urban Waters Routemap, there is significant investment underway to increase data monitors on our overflows by 2024. As part of this work, data capture and availability is being reviewed to allow further enhancements. In due course, we will publish information on the number of days for which monitors are unavailable to support the reporting of 2023 overflow events in January 2024.

The Scottish Government is enabling access to superfast broadband through the £600 million R100 contracts (North, Central and South) and the R100 Scottish Broadband Voucher Scheme (SBVS).

All three island local authority areas are covered by the R100 North Contract, with build already underway in Orkney and Shetland which is expected to conclude in 2026. Build is currently expected to begin in Na H-eileanan Siar in 2025 and conclude in 2028.

In 2022, as part of the R100 North contract, 16 new subsea fibre broadband cables were laid, providing future-proofed, resilient connections to 15 Scottish islands, including 4 islands in Shetland and 7 in Orkney.

All premises not in commercial or R100 contract plans can access a minimum of a superfast service via the R100 Scottish Broadband Voucher Scheme. However, this is a demand-led scheme, meaning it is ultimately up to tenants and owners to secure a connection through this route.

Last year the Scottish Government consulted on proposals for a National Litter and Flytipping Strategy. The consultation included proposals to encourage behaviour change, improve infrastructure and services and strengthen enforcement, including a review of the current enforcement model. A final strategy will be published this year.

In addition, we are supporting local authorities to prepare for the introduction of the Deposit Return Scheme next year, which will help to reduce the amount of waste, including litter, that local authorities have to handle, reducing the £36 million of public money spent annually on associated litter clean-up costs.

We will also be taking forward action to strengthen enforcement through the planned Circular Economy Bill this year.

Engagement between the Scottish Government and Department for Work and Pensions (DWP) in relation to the timing of Winter Heating Payment next winter is already underway. That includes discussion on the transfer of client data to Social Security Scotland.

As set out in S6W-15012 on 6 March 2023, DWP were unable to provide the data prior to 31 January 2023 that would have allowed earlier payments in the first year of delivery.

Public bodies are autonomous bodies and each one has a clear framework which balances operational autonomy and accountability to the public. Any processes in relation to disputes with service users, including in relation to debt to that body, are between the service user and the body, with established dispute resolution processes in place. There are established rights of review and appeal in relation to Social Security Scotland and Council Tax liabilities.

Scottish Ministers have consistently encouraged public bodies to share good practice on debt assistance and collection and to show empathy and dignity when working with people struggling with debt.

Specifically in relation to Council tax, whilst this is a local tax and each council is financially and administratively accountable to their electorate, we recognise the desirability of the best practice in council tax collection being adopted by all local authorities. Ministers raised the issue of Council Tax Debt and Recovery, including highlighting the recommendations of the Improvement Service and Stepchange Scotland’s May 2022 report on Collaborative Council Tax Collection, with the COSLA President, Vice President and Resources Spokesperson at a recent meeting of the ‘Joint Working Group on Sourcing of Local Government Funding and Council Tax Reform’.

Social Security Scotland offers a range of secure communication channels for clients. These do not include email, as unencrypted email is not secure and could place clients’ sensitive personal information at risk or expose the agency’s network and data to malware.

Emails from MSPs/MPs present less risk as it is easier to verify the sender’s identity, so Social Security Scotland does accept constituency casework via email. However, because such emails are unencrypted, client data may still be vulnerable, and Social Security Scotland accordingly recommends that MSPs/MPs use the Social Security Scotland Parliamentarian Enquiry Line as their primary channel for assisting constituents.

Social Security Scotland undertakes a broad and continuous programme of analysis of all aspects of the delivery of benefits, focussed on the live running performance of the system, client experience and evaluation of delivery.

Research on Early Experiences of Child Disability Payment was published in September 2022 and Client Survey research on Child Disability Payment on 8 March 2023. The next publication of Client Survey research on Child Disability Payment is scheduled for early summer.

The evaluation strategy for the benefit is in place and the first output will be published later this year. Analysis will focus on the impact of policy changes to supporting information.

This work informs Social Security Scotland’s approach to continuous improvement and the agency has used it to plan the action currently underway to improve processing times.
