Monitoring and analysis work will commence shortly after the launch of Scotland’s Deposit Return Scheme (DRS). This work was originally scheduled to begin in early 2024.

Following the decision to move the scheme’s launch to 1 March 2024, this work will be rescheduled accordingly.

Scottish Universities are autonomous institutions and as such, except for controlled subjects, the Scottish Government and Government Ministers do not set a student cap or direct individual universities on the number of funded places for individual subjects, available for eligible Scottish and EU domicile students.

Universities are allocated a finite amount of money and it is for universities themselves to decide how to distribute these places between faculties; the courses they offer; and how many of the total funded places will be available on each course. To give universities additional flexibility in student recruitment, the Scottish Funding Council allows universities to recruit up to 10% above the number of funded places awarded.

The Scottish Government firmly believes that access to university should be based on the ability to learn and not the ability to pay, however there is a need to exert a level of control over the higher education budget, which means that the number of students able to access a funded place is not unlimited. Despite these constraints and the cost of living crisis our investment in university education ensures that Scottish domiciled students benefit from free tuition at our world-class universities in near-record numbers.

This means that, unlike elsewhere in the UK, Scottish students studying in Scotland do not incur additional debt of up to £27,750, and that average student loan debt for Scottish students is the lowest in the UK. Even in an environment of secure investment by the government, we still recognise that we have more to do, and all institutions have to work hard to ensure that students from deprived areas receive opportunities to achieve their potential.

The Scottish Government provides an annual update to Parliament on our support for veterans and the Armed Forces community in Scotland. This sets out progress made in delivering the commitments we have made in our Veterans Strategy Action Plan, which is focused on achieving the vision and long term outcomes of the five cross-cutting factors and six key themes in The Strategy for Our Veterans. We have no plans to introduce such a requirement. It is a matter for those relevant public bodies collecting information on sex to establish the best approach in their individual institutional settings. In the case of those committing crime, this approach will rightly be shaped by how Police Scotland, the Crown Office and Procurator Fiscal Service and Scottish Courts and Tribunals Service operationalise both the wider legal context (where for example an arrested person is not legally required to answer questions on their sex or gender) and any associated guidance on collecting data about sex and gender.

The information Police Scotland record on the sex of people, which flows through to partners as any criminal proceedings are taken forward, has no impact on how cases are investigated or prosecuted. It will be based on how people present, unless an alternative gender is disclosed. In respect of the offences of rape and attempted rape, the law requires that there is penetration or attempted penetration of the complainer’s mouth, vagina or anus by the perpetrator’s penis, which includes a surgically constructed penis.

It is imperative that all institutions support victims of sexual assault, and that victims feel comfortable in reporting incidents to their institutions and to the Police.

The Scottish Government has received assurances from the Principal of the University of Edinburgh that it is committed to tackling gender-based violence, and that it would not discourage a student from making a report to the Police. Further discussions with the institution are planned.

The Judiciary and Courts (Scotland) Act 2008, which was passed unanimously by this Parliament, provides that it is the responsibility of the Lord President as Head of the independent judiciary and of Sheriffs Principal, to ensure the efficient disposal of business through Scotland’s courts, including sheriff courts.

Where the Lord President, in consultation with the relevant Sheriff Principal, considers that it is appropriate to establish a specialism in domestic abuse cases in a particular sheriffdom, they are able to do so.

There is no requirement for the involvement or approval of the Scottish Ministers or the Scottish Parliament.

Every public library in Scotland provides access to free WiFi, networked devices and trained staff to offer digital support. The Scottish Government works with the Scottish Library and Information Council (SLIC) to ensure public library staff have access to training to ensure the public receive the support they need. Library Services can apply for funding to develop digital services through the Scottish Government’s Public Library Improvement Fund and latterly (2021-22) through the Scottish Government’s Public Library COVID Relief Fund (£1.25M) both of which are administered by SLIC.

In addition to these routes, The Scottish Government also provided funding for public libraries to support the roll out of NHS Near Me services in public libraries in 2022-23.

The Scottish Government has clear commitments to improve education, and those include more teachers in our schools.

During the pandemic we provided £240 million of additional investment to local authorities to support the recruitment of additional education staff to support education recovery. We recently set out measures to Parliament making it clear that we will provide £145.5 million in next year’s budget to protect increased teacher numbers and support staff. Where this is not being delivered by a local authority, we will withhold or recoup funding that has been given for this purpose.

The 16 August 2023 launch date of Scotland’s Deposit Return Scheme launch date was informed by a five month assessment process. This accounted for the findings of the Gateway Review conducted in June 2021 independent advice, review of Circularity Scotland’s implementation plans, and feedback from a wide range of stakeholders. This launch date was announced in Parliament on 14 December 2021.
