To ask the Scottish Government, in light of the Mental Welfare Commission for Scotland report, Investigation into the care and treatment of Mr TU, published in March 2023, whether it will introduce measures to ensure that all remand prisoners are provided with suitable accommodation and support upon unexpected release, and if this is the case, what the timeline is for implementing such measures.

To ask the Scottish Government what its position is on the reported calls for it to have urgent engagement with the UK Government and international partners regarding securing tariff exemptions for Scotch whisky.
Answer
The Scottish Government continues to engage with all our partners to call for a long-term return to tariff free trading that has been mutually beneficial for the Scottish and US spirits sectors, as part of a wider UK-US negotiated solution. I met with the UK Minister for Trade Policy and Economic Security on 2 April to discuss this. The Deputy First Minister met with the US Chamber of Commerce on 3 April and the First Minister met with senior figures in the whisky sector in New York on 7 April to hear directly from the business leaders involved and hosted a business round table which included the Scotch Whisky Association and the Food and Drink Federation on 16 April. The First Minister also met with the Prime Minister, Sir Keir Starmer, on the 11 April to discuss tariffs amongst other topics.

To ask the Scottish Government what discussions it has had with the UK Government regarding the provision of additional financial support for housing decarbonisation.
Answer
The Scottish Government has regular discussions with the UK Government about heat decarbonisation. For example, we continue to press the UK Government to align delivery of the Energy Company Obligation and Great British Insulation Schemes with Local Heat and Energy Efficiency Strategies.
While heat and energy efficiency are devolved, however, we need to see further and urgent action by the UK Government in reserved areas. These actions, which include market reforms designed to make electricity cheaper to use than gas, will be vital to ensure that the transition is fair and affordable.

To ask the Scottish Government whether it will publish the (a) terms of reference, (b) instructions and (c) scope of the work given, as part of the commissioning process, to the person appointed to research and report on the dual role of the Lord Advocate.
Answer
The Scottish Government commissioned an expert report from Malcolm McMillan on the roles and functions of the Scottish Law Officers. The purpose of the report is to outline the history and development of the roles and functions of the Scottish Law Officers; describe their current roles and functions; highlight the role of Law Officers in a number of other jurisdictions; describe the constitutional context relevant to a review of the roles of the Scottish Law Officers; and provide a summary of insights and comments on the Scottish Law Officers’ roles from former and current holders of these offices and relevant officials. The work to publish the final report is in the final stages.
The remit and terms of reference will be included in the published report.

To ask the Scottish Government whether it responded, other than an acknowledgement, to the letter in February 2024 from the then Secretary of State for Scotland to the then First Minister requesting an update on "whether the dual functions of the Law Officers, as head of the independent prosecution service and principle legal advisers to the Scottish Government should be separated", and, if (a) so, whether it will publish its response and (b) not, when it plans to do so.
Answer
I replied to the letter of 9 February from the then Secretary of State for Scotland, Alister Jack MP on 29 February 2024 in which I confirmed the commission of an expert report and the scope of that report, and that I would keep UK Government informed of planned next steps.
We do not routinely publish correspondence between Scottish Government Ministers and their UK Government counterparts.

To ask the Scottish Government how many meetings the Cabinet Secretary for Justice and Home Affairs has had with the (a) Scottish Fire and Rescue Service, (b) Fire Brigades Union and (c) Fire and Rescue Services Association since 29 March 2023, and what was discussed.
Answer
Portfolio responsibility for fire and rescue sits with myself and therefore the majority of meetings with the Scottish Fire and Rescue Service and its trade unions are undertaken by myself rather than the Cabinet Secretary. The Cabinet Secretary for Justice and Home Affairs joined myself in a meeting with the Fire Brigades Union on 22 November 2023 to discuss the FBU’s Firestorm report.

To ask the Scottish Government what contingency planning it has undertaken to mitigate the economic consequences of any tariffs being placed on Scotch whisky in foreign markets.
Answer
The Scottish Government continues to provide support to the entire food and drink sector to help businesses with their economic growth ambitions. This includes £10 million funding for the period 2023-2025 to support the implementation of Scotland's food and drink strategy “Sustaining Scotland, Supplying the World” which outlines how we are driving growth for businesses across various sectors, including the drinks industry. In addition, we have invested over £7 million in the Scotland Food and Drink Export Plan since 2014, helping Scottish businesses to capitalise on key global market opportunities. Specifically in relation to whisky the Scottish Government continues to actively engage with the UK Government to strike a good deal for whisky in the proposed India Free Trade Agreement, which is the largest market for whisky in the world.
