The Children (Scotland) Act 1995 is the key legislation on contact, residence and parental responsibilities and rights. When the court is deciding whether to make an order under section 11 of the Act (e.g. a contact order) the driving principle of the legislation is that the welfare of the child must be the court’s paramount consideration.

The court must also – taking into account the child's age and maturity – have regard to any views the child wishes to express and have regard to the need to protect the child from any abuse (including domestic abuse), or the risk of any abuse, which affects or might affect the child.

It is for the court to decide what information and evidence it needs to make a decision about what is best for a child. The court may request a range of reports and information before reaching a decision and may appoint a child welfare reporter to get the child’s views or report on the best interests of the child.

The court can order that contact must take place at a child contact centre. This can either be supervised contact, when a trained member of staff observes the contact to ensure the safety of those involved, or supported contact, facilitated by staff who will support children and non-resident parent to meet and spend time together.

It is a matter for Health Boards to consider the implementation of any new medicine to meet the needs of their local population. However, in response to concerns raised regarding access to givinostat in Scotland, the Cabinet Secretary has met with the four health boards who provide regional services across Scotland for children and adults with neuromuscular disorders, including Duchenne Muscular Dystrophy (DMD). He has asked them to set out their timelines and approaches to the families who have children with DMD, and this is now underway. In addition, the Chief Pharmaceutical Officer (CPO) has been assured that the consultants have reviewed all those who eligible to ensure fair and equitable access across Scotland.

Capital funding for the play park renewal programme is distributed to all 32 Local Authorities based on population of 0-14 year olds and rurality. In the first year, the formula was:

1.95% on population 0-14

2.5% on rurality

From 2022-23, the formula was:

1.93% on population 0-14

2.7% on rurality

We continue to support our local authority partners with £16 million in funding a year to ensure access to school counselling services across Scotland.

As part of the commitment, local authorities provide reports on school counselling services which includes number of counsellors in post (this relates to number rather than FTE).

There is variation in how the access to counselling service is being delivered across authorities. Some authorities employ counsellors directly, while others procure third sector counselling.

The following table shows the numbers of counsellors local authorities reported were in post in each of the reporting periods.

The Scottish Government works closely with Local Authorities on the delivery of the renewal programme and use of the funding through the annual reporting process and the quarterly network meetings referenced in S6W-38037. As agreed with COSLA at the start of the funding programme in 2021, Local Authorities are not required to report any such issues.

The Scottish Government is committed to ensuring that parents and carers are central to shaping the development of Additional Support for Learning (ASL) policy. As part of a wider review of ASL, Ministers will consider this publication and its recommendations in addition to other recent reports, which identify areas for improvement.

I have committed to a cross party roundtable with local government to discuss a wider review of the delivery and support for Additional Support Needs in Scotland’s schools. The scope and detail of the review will be informed by the outcome of the roundtable.

Our inclusive approach to education in Scotland is supported by a broad consensus that all children and young people should receive the support they need to thrive. Since the 2020 Morgan Review of ASL, we have delivered over 50 actions to improve educational experiences for children and young people with additional support needs (ASN), empowering them to become directly involved in decision making, increasing learning opportunities for educators and creating parent support groups.

We will continue to work at pace to deliver the remaining actions by the end of this Parliamentary term, including ensuring that parental voice informs the development of ASL policy.

The Scottish Government is working with Ferguson Marine and CMAL to understand fully the basis of the revised delivery plan for MV Glen Rosa. All requests for an additional budget for capital projects require detailed scrutiny processes before they can be approved and decisions taken on sources of funding within the overall Scottish Budget.

The South East Scotland Cancer Network (SCAN) continue to focus on reducing waiting times and improving outcomes for people diagnosed with ovarian cancer. They have made recent innovations in both the pre-diagnosis and post-diagnosis parts of the pathway:

• Pre diagnosis: patients referred with suspected ovarian cancer automatically receive a CT scan appointment and should the scan show any suspicious features, the multi-disciplinary team will review and an action plan will be formalised. They report that this has significantly decreased waiting times.
• Post diagnosis: 10 dedicated advanced ovarian cancer surgery lists are offered each week supported by the specialist gynae-oncology team and the colorectal and hepato-biliary surgery teams, as appropriate, aiming to improve post-surgery outcomes including survival rates.

The Scottish Government collects and publishes data on the total number of diversion from prosecution cases commenced for people aged under 18, this is published in the Justice Social Work Statistics in Scotland: 2023-24 - Part 1.

Over the past five years a total of 3,444 diversion from prosecution cases were started for individuals under 18. However, information on the specific alleged offence in each case is not available.
