To ask the Scottish Government how many incidents of violent crimes were recorded in each of the last 10 years.

Table 1 shows the number of non-sexual crimes of violence recorded by the police in Scotland from 2011-12 to 2020-21. From 2019-20 onwards this includes new crimes recorded under the Domestic Abuse (Scotland) Act 2018, following its enactment on 1 April 2019. In addition to this, Table 2 shows the number of common assaults recorded by the police over the same time period. Both of these tables are available from the Recorded Crime in Scotland National Statistics ( Recorded Crime in Scotland - gov.scot (www.gov.scot) .

Notes:

1. Includes Murder, and Culpable homicide (common law), which includes Causing death by dangerous driving, Causing death by careless driving while under the influence of drink or drugs, Causing death by careless driving, Illegal driver involved in fatal accident and Corporate homicide.

3. The Domestic Abuse (Scotland) Act 2018 came into force 1 April 2019. The Act created a new offence of abusive behaviour as a course of conduct towards a partner or ex-partner. Prior to 1 April 2019, any criminal act which formed part of a domestic abuse incident (such as a Common assault or Threatening or abusive behaviour) was included within the statistics under the relevant crime or offence. Where there is evidence of a course of conduct, new crime codes of Domestic Abuse (Scotland) Act 2018 (against a male or female victim) have been created. In general, existing common law and statutory offences continue to be recorded where appropriate, in addition to the new crimes.

To ask the Scottish Government how many non-disclosure agreements SQA employees have been asked to sign in each of the last five years, and for what reasons.

I have asked SQA to respond:

SQA has not entered into any non-disclosure agreements in the past 5 years. In accordance with the Scottish Public Finance Manual, SQA has entered into settlement agreements and COT3 agreements both of which include a confidentiality clause. A COT3 is a form of settlement agreement which is reached with the assistance of ACAS, usually before a tribunal takes place. The agreements do not under any circumstances prevent an employee from making a protected disclosure under whistleblowing legislation.

To ask the Scottish Government whether small and medium-sized enterprises (SMEs) have been guaranteed a pipeline of low-carbon work.

Looking ahead, we don’t yet know all the products or technologies that will be needed to achieve our climate change targets. However, we are clear that we want a Just Transition, where Scottish-based businesses, their wider supply chains and our local communities understand and benefit from the deliberate shift needed. We want SMEs to be at the heart of this transition, making green products for both the domestic and export markets.

To help facilitate this, the Scottish Government has committed over £2 billion of capital funding over the next parliament to deliver low carbon and natural infrastructure. This includes a number of funds supporting businesses in both making the transition to net zero, as well as supporting them to innovate and improve their green products and services and related research and development. We are already ensuring Scottish SME’s are instrumental in the Scottish Business base. In 2019-2020 the total Scottish public body procurement spend with SMEs was £5.4 billion. This amounts to 46.2% of all spend. 58 pence in every pound spent with suppliers in Scotland in 2019 to 2020 went to an SME.

Looking to the future, the recent ScotWind announcement is one example of ensuring the future investment in our supply chains, that will provide a scale of opportunity for Scotland that will be transformational.

To ask the Scottish Government when the Inner Sound Management Group will next meet, in light of the judgment of the Inner House of the Court of Session in relation to the Inner Sound Pilot Scheme.

Establishing an Inner Sound Management Advisory Group was one of the recommendations from a report of 26 February 2020 regarding a pilot scheme proposal for the Inner Sound of Skye.

The landscape surrounding inshore fisheries management has however changed significantly over this two year period, with the publication of a new fisheries management strategy and the marine elements of the Bute House agreement.

Development of inshore fisheries management in Scotland will continue to be channelled through our Regional Inshore Fisheries Groups (RIFGs), including for the waters around Skye. The RIFG network brings fishers together to work with Government, and in partnership, help deliver management that protects the marine environment and supports a strong, sustainable, and resilient fishing industry.

To ask the Scottish Government whether it will reconsider its decision to redact clause 12.4 on the total aggregate liability in the release of the business purchase agreement in relation to the Dalzell steelworks, as set out in the response to freedom of information request FOI/202100212787, a review of FOI/202100203997.

The original FOI request and the subsequent review were handled by the Scottish Government in compliance with its statutory obligations under the Freedom of Information (Scotland) Act 2002 (FOISA). Where any requester is dissatisfied with the outcome of a review, there is a clear statutory route by which they may appeal to the Scottish Information Commissioner, within six months. Any new request received by the Scottish Government would be considered afresh, in compliance with our obligations under FOISA.

To ask the Scottish Government how disputes about state aid rules are resolved in Scotland post-Brexit, and whether the Court of Session and Supreme Court now have responsibility for interpreting and ruling on any dispute relating to a historic transaction that may have been in violation of pre-Brexit state aid rules.

In relation to measures taken before the end of transition, under Articles 93(1) and 95(1) of the Withdrawal Agreement, the European Commission remains competent until 31 December 2024 to open a State aid investigation in relation to any such measure, and the results of any such investigation are binding on the United Kingdom (and have direct effect in UK law by virtue of Article 4 of the Withdrawal Agreement and section 7A of the EU Withdrawal Act 2018 (“the 2018 Act”)).

To ask the Scottish Government what analysis it has (a) conducted and (b) commissioned on the total potential environmental remediation cost of the Dalzell steelworks.

A soil and groundwater contamination liability assessment covering the Lanarkshire steelworks was prepared for the Scottish Government in 2016.

To ask the Scottish Government what steps it has taken to reduce waiting times for child and adolescent mental health services (CAMHS).

The Scottish Government is committed to improving Mental Health services and the Programme for Government commits to ensuring that by the end of this Parliament, a minimum 10% of frontline NHS spend goes towards mental health, with at least 1% going towards child and adolescent mental health services.

We also remain committed to meet the standard that 90% of children and young people begin treatment within 18 weeks of referral. We have allocated nearly £40m additional funding in 2021-22 to NHS Boards to improve CAMHS from our £120m Recovery and Renewal fund. £4.25m of that allocation is directly focussed on offering treatment to those already on CAMHS waiting lists, with a view to clearing all backlogs by March 2023.

We are closely monitoring those NHS Boards with significant performance challenges and supporting the continuous development of their detailed local improvement plans. The creation of these plans is further supported with direct enhanced support from subject matter experts and the sharing of best practice. This support is centred around and supported by the implementation of the CAMHS national service specification which outlines the expectations of the quality of care that families can expect.

NHS Boards who are receiving this enhanced support have provided trajectories to meet the 90% waiting times standard and we are using these to monitor and drive improvements within CAMHS.
