Scottish Parliament Scrutiny of the Draft National Planning Framework 4
The procedure for scrutiny of a copy of the draft NPF4 requires it to be laid in the Scottish Parliament and for the Scottish Government to consider representations made to it during a period of 120 days (not including recesses of more than 4 days) from the date of laying.

While the reason provided for the breach of the rule is clear and specific to this Order, the timing of laying the Order just in advance of the Easter Parliamentary recess has meant that this Committee and the lead Committee are only in a position to consider the Order in the week commencing 17 April - 3 weeks after the Order has been brought into force.

The instrument was laid on 22 December 2021 and came into force on 1 January 2022, during a recess period. As it was laid less than 28 days before it came into force, it is in breach of section 28(2) of the Interpretation and Legislative Reform (Scotland) Act 2010, which provides that a Scottish statutory instrument, subject to negative procedure, must be laid before Parliament at least 28 days before it comes into force (not counting recess periods of more than 4 days)..

Item 7: Strategic Updates COVID-19 Response 4 7 .1 Michelle Hegarty provided an update on the current COVID-19 response to gradually bringing back services. 7.2 A gradual phased resumption stages on-site had taken place so far and more services had resumed post-summer recess taking account of the requirements of face masks and one-metre distancing.
