Scottish Ministers, alongside Scottish Government officials, have been in regular contact with the UK Government to bring forward legislation to implement the Ivory Act 2018 later this winter. The ban is then expected to come into force in Spring 2022.

The Scottish Government is required to obtain approval from the Scottish Parliament to proceed with proposals by Scottish Ministers to consent to the making of UK secondary legislation affecting devolved areas. I wrote to the Rural Affairs, Islands and Natural Environment Committee in September with notification of our intent to proceed with this secondary legislation. Formal consent to proceed with the legislation is then possible, once the Committee has given it due consideration.

The use of facial recognition technology is an operational decision for Police Scotland, operating within the boundaries of current legislation. The Scottish Government understands from the service that there are no plans to use the technology during COP26, either in a live or retrospective capacity.

The use of facial technology by security teams within the COP26 Blue Zone is a matter for them given the designated status of the area for the duration of the conference.

The first steps in the process of identifying potential areas for National Park status will be to develop and publicise the evaluation process which will be used to determine the area or areas to be proposed as the next National Park in Scotland.

As of 3 November 2021, the Scottish Ministers have received two applications for an exemption from the obligation to operate a return point under Scotland’s Deposit Return Scheme.

Yes. Following the discussions with stakeholders to agree evaluation process to assess bids for National Park status, a call will be made for candidate areas.

To be eligible for National Park Status, under the provisions of the National Parks (Scotland) Act 2000 the area must meet the following 4 Aims:

(a) to conserve and enhance the natural and cultural heritage of the area,

(b) to promote sustainable use of the natural resources of the area,

(c) to promote understanding and enjoyment (including enjoyment in the form of recreation) of the special qualities of the area by the public, and

(d) to promote sustainable economic and social development of the area’s communities

In addition, the Act specifies 3 Conditions which are to be met before a National Park can be designated:

(a) that the area is of outstanding national importance because of its natural heritage or the combination of its natural and cultural heritage,

(b) that the area has a distinctive character and a coherent identity, and

(c) that designating the area as a National Park would meet the special needs of the area and would be the best means of ensuring that the National Park aims are collectively achieved in relation to the area in a co-ordinated way

Satisfying the Aims and Conditions of National Park will be the first step in identifying the area or areas to be taken forward. Further criterion will be required to evaluate the list of candidate areas. The first step in the process will be to develop and publicise this initial evaluation process.

As part of our Future Skills Action Plan, we will provide more opportunities for the current workforce to upskill and retrain. To support this, we increased our investment in workforce development to £20m per annum from
‎ 2020-21.

The Flexible workforce Development Fund is now open to all employers, with up to £15,000 per year available for UK Government Apprenticeship Levy payers and £5,000 for SMEs to support workforce development supporting business growth.

In some sectors, such as Tourism and Hospitality, Cyber Security, green Construction, Aviation, Aerospace, and Digital, the National Transition Training Fund is supporting in-work skills development to enable economic recovery from Covid-19 and EU exit, as well as helping businesses gain the skills to for the transition to net zero.

In the current financial year, there is also support for businesses in Aberdeen and Aberdeenshire through the North East Economic Recovery and Skills Fund. This £14.3m fund recognises the dual impact of the Covid-19 pandemic and the downturn in Oil and Gas/ Local partners are working with businesses in key sectors to provide skills support to aid economic recovery in the area.

The need to raise awareness amongst employers on the necessary behaviour changes that will support a just transition to net zero is also recognised as a priority area in the Climate Emergency Skills Action Plan (CESAP), which was published in December 2020.

The current activity taken as part of the CESAP includes training developed by Keep Scotland Beautiful that has helped organisations to better understand the climate emergency and respond to the risks and opportunities it presents and the development of multi-disciplinary training on natural capital approaches. In addition to the actions already being taken, over the next year there will be a ‘toolkit’ developed to help small/micro businesses develop the skills and knowledge they need to adapt to the demands of the transition to net zero.

Under Zero Waste Scotland’s Revolve certification scheme the number of stores reporting fluctuates year on year which leads to variations in data collated. Zero Waste Scotland do not receive data from all certified stores in a given year.

The data is self-reported by reuse stores, who can update monitoring processes for their unique circumstances over time.

While Zero Waste Scotland collect data on sales income, it does not hold data on the full "economic impact" of the reuse stores which would also include metrics such as other income, services provided, alongside social and employment impact.

The Scottish Government’s position is that VAT should not be applied to deposits charged under Scotland’s Deposit Return Scheme (DRS) and we have made official and ministerial representations on this issue. It is important that where we can we promote rather than hinder progress towards a circular economy.

As VAT is a reserved matter, the final decision will rest with the UK Government and will be for them to confirm.
