Scottish Government were advised of Mr Alexander’s death by NHS Ayrshire & Arran on 16 February 2021. At that time, the Board also confirmed that a review was ongoing to determine Reporting of Injuries, Diseases and Dangerous Occurrence Regulations (RIDDOR) reportable status. They further advised that the Health and Safety Executive had been advised by telephone of the death of a member of staff and that NHS Ayrshire & Arran would submit a RIDDOR notification if the internal review indicated this requirement.

Scottish Government has since been advised that in accordance with Health and Safety Executive COVID-19 RIDDOR guidance, Mr Alexander’s death was not, and has not, been formally reported to the Health and Safety Executive as it did not meet the requirements for reporting under RIDDOR.

Ministers will set out a statement of policy on the factors to be taken into account when considering whether to use the discretionary power within the UK Withdrawal from the EU (Continuity) (Scotland) Act 2021 in the coming months .

I would refer the Member to the fact as previously answered in S6W–02319 on 21 September 2021, prison staff are under no obligation to tell their employer of their Vaccination status, as it is not mandatory to be vaccinated. Although staff are paid away from work to attend a vaccination appointment and are offered paid leave if symptoms deliver, as part of employee support arrangements.

We are guided on the rollout of the COVID-19 vaccination programme by the Covid Vaccine Deployment Plan which was last updated in July 2021.

We are actively monitoring and evaluating the vaccination status for prisoners and young offenders. NHS bodies and public health agencies, are working collectively with The Scottish Prison Service (SPS) to ensure we are constantly striving to make progress, on these matters, to ensure best practice is maintained. Each prison establishment has a Local Coronavirus Response Group to assist with planning locally.

The Scottish Government is clear that we wish to maintain and advance the high standards Scotland has enjoyed as part of the EU. Ministers have no current plans to use the discretionary powers to align with the European Union legislation provided through the UK Withdrawal from the EU (Continuity) (Scotland) Act 2021 in the area of nature restoration legislation.

The Scottish Government has been working in collaboration with Public Health Scotland and the Scottish Prison Service to improve data on COVID-19 vaccination uptake in Scottish prisons.

Prison vaccination data will now be reported on a regular basis and will assist in considering possible courses of action to improve the vaccination uptake amongst the prison population, including for individuals who have not received their second dose prior to being released from prison.

The NHS Scotland COVID Status app is being developed for release to the public by the end of September with vaccination information initially. We are developing our app to meet the EU requirements so we expect this to be compatible with the IATA Travel Pass. We are engaging with international stakeholders and UK Government to ensure the app is compatible with the other countries requirements of entry.

PDF downloads of vaccination status and 2D barcodes (known as QR codes) were made available for international travel from 3 September to facilitate international travel.

The Scottish Government and Scottish Green Party: Shared Policy Programme sets out that we will phase out the need to install new or replacement fossil fuel boilers in off-gas grid homes from 2025 and in on-gas grid areas from 2030, subject to technological developments and decisions by the UK Government in reserved areas.

The Shared Policy Programme also commits to introducing primary legislation, subject to consultation and to limits on devolved competence, that provides a regulatory framework for zero emissions heating (and energy efficiency), and underpinning powers to support this transition and ambitious programme.

The exact operation of the proposed regulations, and any ensuing obligations on current users of gas boilers, is still to be determined but to ensure that the approach is fair, and to avoid unintended consequences, this will be subject to a detailed consultation in 2022.

Local authorities are independent corporate bodies with their own powers and responsibilities, separate from the Scottish Government. As such, the information requested is not held by the Scottish Government and would have to be obtained directly from individual local authorities or from COSLA.
