As part of the usual budget process within government, the Cabinet Secretary for Justice and Home Affairs met with the Cabinet Secretary for Finance and Local Government on a bilateral basis on 6 November 2024 and 20 March 2025. The specific issue of funding for the Scottish Violence Reduction Unit was not discussed as part of those meetings. The Scottish Government has provided increased funding for the Scottish Violence Reduction Unit for 2025-26 as part of its broader package to tackle violence and on the basis of them being able to provide additional impact from this funding.

Many parts of the childcare sector operate under a mixed economy model where they receive income from different sources, including directly from their local authority to support the delivery of funded early learning and childcare (ELC). For example, the 2023 Financial Sustainability Health Check reported that public funding accounted for, on average, around 46% of overall income for private childcare services who delivered funded ELC.

The payment of sustainable rates to providers delivering funded ELC is vital to the financial sustainability of these providers.

This is why the Scottish Government and COSLA undertook a joint Sustainable Rates Review in 2023. Through evidence from providers and local authorities, it identified a risk that some providers were not being as effectively supported as others by rates at the time of the review.

To address this, work is underway to improve the data available to inform funded ELC rates-setting by local authorities. The Scottish Government has contracted the Diffley Partnership to undertake a new funded ELC cost survey. The findings will inform future sustainable rates-setting and the Scottish Government and COSLA’s future financial planning.

While work is underway to improve rates-setting processes, the childcare sector in Scotland has been impacted significantly by the UK Government’s unilateral changes to employer National Insurance Contributions. We estimate that these changes will add £5 million per year to funded providers’ costs for the delivery of funded ELC (with higher additional costs expected for the whole of the childcare sector).

The Scottish Government called on the Chancellor to fund these costs in full, including the costs for commissioned services such as ELC, but she has failed to do so. The additional funding of £339 million being provided by the UK Government falls far short of the estimated additional costs and means that public services in Scotland still face a £400 million shortfall.

The Scottish Government is considering carefully the implications of the UK Supreme Court judgment. In taking any steps to implement the judgment, we will do so in a manner that is consistent with our human rights obligations, including those under the Human Rights Act 1998. In our updates to public bodies, we have highlighted the importance of compliance with legal obligations.

The Scottish Government has not received any formal proposals for additional sites for additional SDCF beyond the Glasgow pilot therefore no budget is currently allocated for this.

Any future consideration on funding will be contingent on the submission of robust, locally led proposals that demonstrate strong community engagement, comply with legal and operational requirements set out by the Lord Advocate and align with national public health priorities.

The Scottish Ministers have decided to recall the Lomond Banks appeal as the proposed development raises issues of national significance in view of its potential impact on Loch Lomond and the Trossachs National Park. Ministers will make the decision on this appeal and will give full and proper consideration to it.

The economic impact of a proposed development is one of several factors considered when determining appeals. In reaching a decision, Ministers are required by law to have regard to the development plan and to all relevant material factors, including all submissions made by parties involved in the case and all representations made.

This remains a live appeal, and it would not be appropriate to comment on the merits of the case, nor on any specific issues that may be involved in the consideration and decision-making process.

Public Health Scotland have advised that the findings of their investigation into the decline in alcohol treatment numbers over the last decade is due to be published in late Summer 2025.

Decisions on whether to install defibrillators in schools are a matter for Local Authorities.

The Out-of-Hospital Cardiac Arrest Strategy: 2021-2026 does not include a specific commitment to placing defibrillators in Scottish schools. Our policy is to work with Save a Life for Scotland partners, taking a data driven approach, to optimise defibrillator placement and ensure they are publicly accessible and registered with the Scottish Ambulance Service.

The Scottish Government provided the Resuscitation Research Group funding for PADmap. PADmap is a free to use, data-driven service to help defibrillator guardians make informed decisions about where to place their devices in order to have the most impact.

The proportion of orders where an individual was taken to a police station as a place of safety has differed over the years but has decreased from 6.6% in 2014-15 to 1.8% in 2023-24.

Additionally, following the publication of HMICS’ thematic review of policing mental health in October 2023, the Scottish Government is working with its partners through the Mental Health Unscheduled Care Network to take forward the recommendations of the national review of psychiatric emergency plans (PEPs) to improve the detention process and removing barriers to multi-agency working when responding to a psychiatric emergency. A national PEP template and accompanying guidance are in development to improve national consistency and ensure that local roles, responsibilities and processes are clearly articulated.

The Scottish Government also published its Safe Spaces Scoping Report in October 2024. It explores the feasibility of implementing additional safe spaces for people experiencing crisis and acute emotional distress as an alternative to Emergency Departments and place of safety. Following the publication, we continue to consider with our stakeholders, the next steps.

An open and transparent criminal justice system is important to allow for justice to be delivered and seen to be delivered so communities can have confidence in how offending behaviour is being dealt with. However, there can be areas of the operation of the criminal justice system where it is considered appropriate to allow certain individuals to remain anonymous to protect their dignity and privacy while still ensuring justice is able to be delivered.

Provisions to introduce new statutory anonymity protections for sexual offence victims as well as victims of certain other offences are contained in the Victims, Witnesses, and Justice Reform (Scotland) Bill which is currently before Parliament. If approved, the legislation will introduce these new protections to help protect the dignity of victims of these offences.

We held a public consultation on media reporting on child homicide victims between 9 July 2024 and 1 October 2024. We asked for views on a range of possible approaches to reducing the trauma that media reporting can have on bereaved families, and on the wider impacts those approaches might have. This included inviting views on legislating to provide automatic or ‘on application’ anonymity for child victims. The analysis of consultation responses was published on 24 February 2025.

The consultation made clear that there would be serious complexities with legislating to anonymise the victims of child homicide in a way that avoided unintended consequences (like criminalising bereaved family members); that struck a robust balance between privacy rights and freedom of expression; and that could be enforced in practice. However, many of the experiences highlighted in consultation responses vividly illustrate the need for more sensitive reporting on these cases. We are therefore working with stakeholders to explore a range of non-legislative measures including support materials for bereaved families, media guidance and training. The Children (Care and Justice) (Scotland) Bill – which underwent Parliamentary consideration from 2022 to 2024 – contained provisions, on introduction, extending the anonymity for child suspects, accused, victims or witnesses both prior to and subsequent to any criminal court proceedings. This followed public consultation, with the analysis published on 8 September 2022. The provisions were further amended at Stage 2 to extend that, in relation to child victims and witnesses, anonymity could continue after a person turns 18 just as was the case for child suspects/accused. These provisions were amended out at Stage 3. Scottish Ministers gave a full account of the reasoning to the Parliamentary chamber. This is contained in the Official Report of 24 April 2024.
