Section 23 of the Scotland Act 1998 states:"The Parliament may require any person … to produce documents in his custody or under his control, concerning any subject for which any member of the Scottish Executive has general responsibility."
There are also a couple of other issues that members may wish to raise. Are members content for the clerks to arrange further meetings, so that we can deal with that business?
The Executive response rules out taking socioeconomic considerations into account as part of the appeals process, because of a European Court of Justice ruling that only scientific matters may be considered. That is something that the Transport and the Environment Committee may wish to consider.
PAN 58 recommends even earlier consultation with the public in relation to EIA, at the scoping stage for example."The question of consultation may have caused confusion, but it does not seem that community councils are excluded from the process.
There may be merit in addressing that. We are entitled to ask for information on existing practices, procedures and guidance, to ensure that such matters are being dealt with properly.

I believe that we need something much clearer than what we have received from COSLA, although members may disagree. I am not 100 per cent happy with the COSLA report.
