I would need to take advice on whether that procedure would always work if one party was dead. There may also be a role for the registrar general for Scotland.
It might be worth getting CACFOA's view on whether the provisions in the highway code are sufficient; if it thinks that they are not, it may want to take that up with the relevant minister, who may be able to address the issue.
I agree with Mike Watson that we should not approach the issue purely through the prism of what may or may not happen in England, but there are undoubtedly issues to be considered.
