(g) may quash or confirm the decision made under section 47(1A)(b) of the 2007 Act (to reinstate a discontinued investigation), (h) if it confirms the decision, may direct the Council as to which aspects of the complaint should be continued. [468] (2) On an appeal to the Tribunal by the complainer [468] under section 42ZA(10) the Tribunal— (a) may quash the determination being appealed against and make a determination upholding the complaint; and if it does so— (i) must censure the solicitor, (ii) may, subject to subsection (5), direct the solicitor to pay a fine not exceeding £2,000, (iii) order that the solicitor’s practising certificate is to be subject to such conditions as the Tribunal may direct, [468] (b) if it does so, may, where it considers that the complainer has been directly affected by the conduct, direct the solicitor to pay compensation of such amount, not exceeding £5,000, as it may specify to the complainer for loss, inconvenience or distress resulting from the conduct; (c) may confirm the determination.
