Electoral reform in Scotland and the Scottish Elections (Representation and Reform) Bill - Part 2: Disqualification

Part 2: Disqualification As explained earlier in this briefing, concern has been raised around the intimidation of candidates and campaigners at elections. The Bill makes four proposals relating to disqualification: creates a new Scottish disqualification order extends the effect of a disqualification order made under the Elections Act 2022 to stop any person subject to such an order from being able to be an MSP or a councillor provides for temporary relief from the effect of disqualification ends the 'ambulatory effect of section 15 of the Scotland Act 1998' - i.e., ends the automatic link between disqualification from being a member of the House of Commons and disqualification as a member of the Scottish Parliament.
