The food standards agency should not be used to penalise Scottish producers unfairly. The overregulation of food producers, which is not matched by the regulation of EU and other overseas producers, leads to an overall competitive disadvantage for producers in this country—for our farmers and for our food industries.

It could describe carefully what the law currently is—that has not been done in the consultation paper—and then identify why it is thought that those arrangements are ineffective. It could also produce proposals that are consistent with, and an improvement on, the existing law but that do not make the existing law more difficult to understand.
