NatureScot submission of 7 March 2022 PE1895/E - Mandatory accountability for Naturescot’s decision making procedures Our wildlife laws are a vital tool to protect our native wildlife.
Issues have been raised in relation to five of the instruments for failure to lay them in accordance with the requirements under section 28(2) of the Interpretation and Legislative Reform (Scotland) Act 2010.
It would lead on the scrutiny of overall governmental performance in driving net zero, and securing economic and social benefit from it, and in holding to account the minister in the next Scottish Government given that cross-cutting responsibility.
Scottish Ministers are then required “as soon as practicable” after the submission of the report to lay before the Parliament a copy of the report and a draft of an Order in Council for giving effect to the recommendations contained in the report.
The Committee noted that there had been a failure to lay the instrument in accordance with section 28(2) of the Interpretation and Legislative Reform (Scotland) Act 2010.

The Policy Memorandum states:
A fundamental tenet of the human rights-based approach to the NCS is providing accountability to those accessing support and empowering them to claim their care-specific rights.
Section 11A requires Public Health Scotland to prepare, lay before the Scottish Parliament and publish ten annual reports on the implementation of the Bill. 6.
What does that mean in practical terms? To whom is it accountable? Registers of Scotland is accountable to Parliament, and sessions such as this are part of that accountability.
