Policy Memorandum Dogs Protection of Livestock Amendment Scotland Bill
People with disabilities may rely on assistance dogs. Under the 1953 Act, the offence of allowing a dog to be “at large” in a field or enclosure in which there are sheep (s.1(2)(c)) does not apply if the dog is a “guide dog” but this is likely to be interpreted only to include guide dogs for the blind and to exclude other assistance dogs such as those trained to assist the deaf or people with epilepsy.
