The Bill will create a new Scottish Biometrics Commissioner and provides for a code of practice to support and promote good practice and consistent standards in relation to the acquisition, retention, use and destruction of biometric data by the police.

It agrees with the findings in fact and conclusion of the commissioner that Rachael Hamilton MSP and Jackson Carlaw MSP did not breach the code of conduct. Although no breach of the code of conduct has taken place on this occasion, the committee reminds all members of the confidentiality provisions in the code of conduct.

In February 2020 the Committee considered an annual monitoring report on Groups' compliance with the Code of Conduct. The Committee agreed to take no action against any Groups who had breached the Code of Conduct due to the restrictions caused by the Coronavirus.
