Stage 1 Report on the Bankruptcy and Diligence (Scotland) Bill - Statutory Interest

The Law Society of Scotland is calling for the law in this area to be clarified and suggested, where there was more than six months between bankruptcy and an application for recall, statutory interest should be payable. In his letter dated 4 September 2023, the Minister for Community Wealth and Public Finance indicated that the Scottish Government proposes to bring forward secondary legislation to change the statutory rate of interest to the Bank of England base rate plus 2%.
