Stage 1 report on the Dog Theft (Scotland) Bill - View that a statutory offence would be used more in practice than the existing common law offence
In the Minister's letter to the Committee, dated 15 May 2025, she explained that it was not appropriate to make a comparison with the statutory offence of breach of the peace as the section 38 offence is not an example of common law being directly replaced by a statutory offence.
