The Scottish Parliament will be notified of any UK statutory instruments made within devolved competence under an agreement with the Scottish Government called the Session 7 Statutory Instrument Protocol. If a Bill gives UK and Scottish Ministers concurrent powers (meaning either UK or Scottish Ministers could make secondary legislation to align with EU law in devolved areas) then how decisions are made on which Ministers exercise powers will be important considerations for the Parliament in Session 7.
