In fact, section 37(7)"of the Adults with Incapacity (Scotland) Act 2000"states that the form ‘shall be reviewed' in those circumstances, which is significantly different. The point was raised with the Executive … the Executive accepts that the Note to the form in Schedule 1 does not exactly reflect the wording in section 37(7) of the 2000 Act.
