Stage 1 Report on the Regulation of Legal Services (Scotland) Bill - Powers to Scottish Government Ministers
The Rt Hon Lady Dorrian told us the senior judiciary had “grave concerns” as under the Bill the Scottish Ministers would be given “direct control to change the professional obligations of lawyers, to reassign regulatory categories, to review the performance of or impose sanctions on the regulator, to directly exercise power to regulate the profession and even to set up an entirely new regulator” and those provisions “clearly transgress against adherence to the rule of law as do provisions that require the Lord President to act jointly with the Scottish Ministers.”1Scottish Parliament.
