The "search of a child without warrant under existing enactment"iiSection 25, Age of Criminal Responsibility (Scotland) Bill – that is, the ability to search a child under 12 where their behaviour would have justified a search under existing statutory search powers if they were over 12.
Section 26 of the Bill provides for an order authorising the search of a child under 12 in certain circumstances (e.g. if the child is behaving in a violent or sexually violent way).
