Following the March 2023 gateway review we established an expanded governance framework with representation from all key stakeholders. This includes a Ministerial Strategic Assurance Group, which sits above the already established Executive Oversight Group and Sector Specific Working Groups.

I refer the member to my answer to S6W-18538 on 15 June 2023 that noted end to end testing was planned as part of CSL’s Programme Delivery activity to ensure successful completion of agreed outcomes. The testing was planned prior to the UK Government’s decision on 26 May 2023 not to agree a full exclusion, removing glass and imposing unworkable conditions on Scotland’s scheme, leaving the Scottish Government with no other option than to delay launch until October 2025 at the earliest. The Private Residential Tenancy was designed so that one tenant cannot terminate a joint tenancy on behalf of all the joint tenants, as this could result in a person who wished to stay in the let property being made homeless when another tenant chooses to leave.

Current legislation does give the landlord the right to decide not to agree to continuing the existing tenancy in those circumstances and can request that a new tenancy be issued at the point of a new person moving into the property. As the rent cap element of the emergency Cost of Living (Tenant Protection) (Scotland) Act 2022 applies only to in-tenancy rent increases, where a new tenancy is created the landlord is able to increase the rent being requested.

Whilst we believe the emergency Act is bringing significant extra protections for people living in the private rented sector during the ongoing cost crisis, it was not able to make more fundamental changes to the Private Housing (Tenancies) (Scotland) Act 2016 with respect to joint tenancy arrangements.

The Cost of Living (Tenant Protection) (Scotland) Act 2022 aims to ensure that the majority of tenants living in the private rented sector are protected by the temporary, emergency measures.

Tenancies under the Rent (Scotland) Act 1984 are exempt from the temporary rent cap, and there are only a small number of remaining tenancies under this Act. For these tenancies, rent increases can only occur every 3 years and the restrictions on rent increases already built into the system operate to ensure rents in respect of the 1984 Act are raised at fair levels.

The UK National Screening Committee (UK NSC), an independent advisory group which makes recommendations on all screening programmes in the UK, have never recommended routine breast screening for women over 71 years. The Committee has concluded that there is not clear evidence that the benefits of screening women in this age group outweigh the potential risks of harm.

Nonetheless, prior to the COVID pandemic, women over 71 could self-refer to be screened if they chose. As the service continues to recover from the pandemic, Women aged 71-74, and those over 75 with a history of breast cancer, are once again eligible to self-refer for a screening appointment. There continues to be a pause in self-referral appointments for women aged 75 and over without a history of breast cancer.

The Scottish Government understands the wish to widen self-referrals to include those over the age of 75 without a history of breast cancer. However, before doing so we need to understand the impact of current self-referral appointments on wait times for women between 50-70 for whom screening has clear benefits. These impacts are under regular review by the breast screening programme board.

A financial modelling exercise for the cost of re-opening the Independent Living Fund (ILF) 2015 Fund was carried out for the Independent Review of Adult Social Care (IRASC) and explored the number of people in receipt of care packages over a range of support costs. This analysis suggested £32 million per annum was required to re-open the ILF 2015 Fund based on an indicative care package value of £600 per week.

Subsequently the SG undertook further analysis to better understand the data relating to the costs of care packages offered by Local Authorities (LAs). This identified significant variations in how these costs are recorded and therefore uncertainty around likely costs of reopening the ILF 2015 Fund. Work is ongoing to improve social care data more broadly to support the establishment of the National Care Service in Scotland.

Scottish Government has made no recent assessment of the merits of introducing national guidance on liver disease to address the specific epidemiology of liver disease in Scotland.

However, there are policy initiatives to address the main risk factors associated with chronic liver disease, such as alcohol use, obesity and hepatitis C.

These policy initiatives include Minimum Unit Price for alcohol, Scotland’s diet and healthy weight delivery plan to address obesity and effective elimination of hepatitis C by 2024.

The Scottish Government has not yet committed further funding for the pilot Pancreatic and Hepatocellular Cancer Pathway Improvement Project. Initial evaluation is scheduled to take place over the summer with outputs due to be reported in September 2023. Decisions on long term funding will be made as the pilot’s impacts and outcomes are fully evaluated.

While funding is provided by Scottish Government to support recruitment and retention initiatives in primary care services, such as Golden Hellos, practices are paid directly from this available funding by NHS Boards upon receipt of an eligible application. As the administration of initiatives is delegated to NHS Boards, Scottish Government does not hold detail of payments made as the data is held locally.

Under this Government, spending on additional support for learning has reached a record high of £830m in 2021-22 and the number of pupil support staff in Scotland has reached a record high of over 16,600. We have invested an additional £60m since 2019-20 (£15m per year) and provide over £11m of funding to directly support pupils with complex additional support needs and services to children and families.

We do not hold information regarding the allocation of specific additional support needs budgets in each local authority or a breakdown of the expenditure of these budgets.

The Additional Support for Learning Act places duties on education authorities to identify, provide for and review the additional support needs of their pupils. It is for individual authorities to determine the training required for all staff to ensure pupils reach their full potential and to manage their budgets accordingly.

All initial teacher education programmes must align with the General Teaching Council for Scotland’s Standard for Provisional Registration. The Standard sets out that student teachers are required to demonstrate knowledge and understanding of additional support needs and to take account of learners with such needs.
