The Scottish Government’s aim is to support high quality, relevant, appropriate and accessible ESOL provision that meets learner need. The Scottish Government’s ESOL funding is currently provided through colleges as part of the grant allocated to the Scottish Funding Council. Colleges are instructed to work with Community Planning Partnerships (CPPs) to determine the level of need for provision and agree with partners how this need can be met.

In addition to this, I have announced an independent review of Community Learning and Development (CLD) which includes ESOL learning. The Independent Review of CLD offers a timely opportunity to better understand how we can ensure that proposed changes to the education and skills system has a focus on the most marginalised learners. Given the ongoing work to reform the education sector, and the intention of the review to provide recommendations on how CLD, including ESOL learning, can best fit within it, it makes sense to pause implementation of the adult learning strategy until such time as the future shape and strategic orientation of CLD is considered.

Scottish Ministers have advised the Operators of both the Northern Isles and Clyde & Hebrides Ferry Service contracts that bookings can be opened beyond the end of March 2024. Operators are now working to open bookings as quickly as possible.

Last month concluded a series of summits I held with a wide range of stakeholders on behaviour in schools. Members are aware that September’s summit on relationships and behaviour in schools focused on recording and monitoring incidents. My aim from the summit process was to identify practical actions we need to make progress, including to create a culture where staff are empowered to record incidents. Local data must then be used to ensure schools both have an oversight of issues and are responding effectively.

I was clear in my statement to Parliament on 29 November that I encourage, in the strongest possible terms, more accurate recording of all incidents of inappropriate, abusive or violent behaviour in our schools.

Our national guidance on recording and monitoring bullying incidents makes clear that all schools and local authorities are expected to record all incidents of violent behaviour. Recording and monitoring plays an essential role in helping schools identify recurring patterns of behaviour and ensure early intervention and appropriate support. It is up to schools to decide how children and young people can report incidents based on local needs and circumstances, which may include anonymised reporting.

The Scottish Government is currently working with the Scottish Advisory Group for Relationships and Behaviour in Schools to develop a national action plan which we expect to be published early in the new year. I will update parliament on the action plan in due course.

The Behaviour in Scottish Schools Research was also published and considered as part of the final summit, which set out that while the majority of pupils are well behaved there has been an increase in disruptive behaviours.

To support local authorities and schools, we published guidance in June 2017 - ‘ Included, Engaged and Involved – Part 2 – preventing and managing school exclusions’ . This guidance gives a stronger focus on supporting positive behaviour and approaches that can be used to prevent the need for exclusion. The guidance sets out an expectation that education authorities and schools will use the guidance to revise and review existing policies and procedures on exclusion, taking account of local circumstances and involving all partners in the development of the new policy.

Education Scotland has also published a resource to support schools or local authorities who are refreshing or reviewing their relationships and behaviour policies. This guidance on developing a local relationships and behaviour policy is available at Guidance for developing a local relationships and behaviour policy (education.gov.scot) .

Finally, we are currently working with the Scottish Advisory Group for Relationships and Behaviour in Schools to develop a national action plan on relationships and behaviour which we expect to be published early in the new year. We will update parliament on the action plan in due course.

The Scottish Government is committed to protecting learning hours in Scottish schools. We are carefully considering the responses to the consultation on learning hours that closed earlier this year. We will publish our analysis of the consultation and engage further with stakeholders, including COSLA, on next steps in due course.

The selection of a site and the configuration of wind turbines is a matter for the wind farm developer. This process involves comprehensive analysis to ensure the most suitable placement and design for wind turbines. Developers may have to balance the benefits of a compact site, which can minimise construction cost, and the gains from maximising energy capture from greater separation distances.

The Hagshaw Energy Cluster provides an example of how industry stakeholders can work collaboratively to promote and adopt a coordinated approach to future renewable energy development.

Policy 11: Energy of National Planning Framework 4 (NPF4) states that potential cumulative impacts are important considerations in the decision-making process. All applications are subject to site-specific assessments.

The Scottish Government has no plans to do so. The consultation planned for 2024 will, in relation to divorce and dissolution, cover court procedures rather than the grounds of divorce and dissolution.

There has been recent legislation for England and Wales which changed the law on divorce and dissolution of civil partnership. Before the changes, two of the grounds of divorce in England and Wales were based on periods of separation: two years if both spouses consented to the divorce and five years otherwise.

In Scotland, irretrievable breakdown of the marriage for the purposes of divorce can be established in a number of ways, including non-cohabitation. The required periods of non-cohabitation were reduced by the Family Law (Scotland) Act 2006 to one year if both parties consent to the divorce and two years otherwise. The 2006 Act also reduced the non-cohabitation periods for dissolution of civil partnership.

The vast majority of divorces and dissolutions in Scotland are on the bases of non-cohabitation: Supporting documents - Civil justice statistics in Scotland 2021-22 - gov.scot (www.gov.scot) (see Divorce and Dissolutions Supplementary Tables 2021-22; tables 2 and 3).

The Scottish Government remains strongly opposed to the Strikes (Minimum Service Levels) Act 2023 and any associated secondary legislation which affects devolved services. This legislation seeks to undermine legitimate trade union activity and does not respect the Scottish Government’s Fair Work principles. We should be working with trade unions to reach fair and reasonable settlements respecting the legitimate interest of workers, not seeking to curb their right to strike.

Under the Strikes (Minimum Service Levels) Act it is a matter for individual employers in the affected sectors to decide whether to issue work notices to trade unions specifying the workforce required to meet minimum service levels for a particular strike period. We have no intention of directing any employers within their control to issue work notices and will do all we can to oppose this appalling piece of anti-worker and anti-trade union legislation, which will undermine not enhance industrial relations.
