The Minister for Parliamentary Business regularly discusses legislative proposals and potential legislative vehicles with his Ministerial colleagues, including the proposed Wellbeing and Sustainable Development Bill. However, introduction of specific primary legislation is considered in the wider context of overall legislative programmes. Decisions on future legislative programmes are a matter for Cabinet and will be announced in relevant Programmes for Government, in the normal way.

In the 2023-24 Programme for Government, the Scottish Government stated its commitment to continue to explore the development of legislative proposals on a wellbeing and sustainable development Bill, to support greater implementation of the NPF, and to ensure the interests of future generations are taken into account in decisions made today.

The Women’s Health Plan recognises that it is important all women know about the menopause and have access to consistent information and care when they seek help with menopause symptoms.

The Scottish Government continues to promote the comprehensive menopause resource on the NHS Inform Women’s Health Platform . This resource was launched in October 2021 to ensure women have access to information on menopause, including the signs and symptoms of perimenopause. The resource includes 11 videos including common myths around the menopause, and personal stories. The resource is accessible in five language translations, British Sign Language translation and an Easy Read version of the content.

To raise awareness of the symptoms of menopause – and how to mitigate them – work has recently begun on the development of a menopause public health campaign.

The Health and Social Care Alliance Scotland (the ALLIANCE), in partnership with the Scottish Government, have hosted a series of webinars to raise awareness about the menopause, focussing on menopause myth busting, menopause and the workplace and menopause, sex and relationships. Additionally, to mark World Menopause Day on 18 October 2023, the Scottish Government and the ALLIANCE, hosted a virtual ‘Talk Menopause’ panel discussion with experts in menopause to provide more information on menopause to those who need it.

One of the key aims in the Women’s Health Plan is to ensure that all women will have access to a healthcare professional with an interest in menopause through primary care, and that in the longer term, we build a basic understanding of menopause amongst all healthcare professionals.

In order for primary care professionals to be able to enhance their skills in menopause care, the Scottish Government has commissioned NHS Education for Scotland to create a bespoke training package and framework which is focussed on menopause and menstrual health for general practice and others working in Primary Care.

There is now a menopause specialist in every mainland NHS Board, with a buddy system in place for the Island Boards. Through the National Menopause Specialists Network these local specialists support primary care teams through the provision of access to a menopause specialist for consistent advice, support, onward referral, leadership and training.

The Mental Health (Care and Treatment) (Scotland) Act 2003 provides for rigorous safeguards in respect of individuals’ human rights. Sometimes compulsory treatment needs to be carried out on an emergency basis and consent from a Mental Health Officer (MHO), in addition to authorisation from a medical practitioner, plays an important safeguarding role in these cases.

However, the 2003 Act also recognises that there may be occasions where the urgency of the situation is so great that it would not be practicable for such consultation to take place. In such cases, the practitioner must inform hospital managers who must then inform the Mental Welfare Commission and notify the relevant authority of the reasons why it was impracticable to consult and seek the consent of an MHO.

Whilst we acknowledge that for some of the 60% of cases mentioned the urgency of the case will explain the lack of MHO consent, we also recognise that MHO capacity is a contributing factor. While it is the responsibility of Local Authorities to ensure they have the appropriate levels of MHOs in place, the Scottish Government felt it was necessary to intervene, and since 2019, we have provided additional funding, as well as working with COSLA and other partners to progress a range of actions to improve workforce capacity and MHO training.

In this financial year we have made available an additional £3.71 million to local authorities to build additional MHO capacity. This will help reduce the number of emergency detentions taking place without the additional safeguard of MHO consent.

The Mental Health and Capacity Reform Programme considers how we can update and modernise mental health and capacity legislation to better reflect international human rights standards regarding safeguards. We will continue to work closely with the Mental Welfare Commission on this.

Governance for the programme is provided by the Digital Prescribing and Dispensing Programme Board which met for the first time in November 2021. The Board has met regularly since then and stakeholder representation includes:

• Royal College of General Practitioners Scotland
• Scottish General Practitioners Committee (of the British Medical Association)
• Community Pharmacy Scotland
• Non-Medical Prescribers Group
• NSS Contractor Prescribing Payments team

At each meeting, the Board discusses key issues and interdependencies such as appliance supply. This will ensure that we continue to develop and adapt as necessary through the life of the programme. At the appropriate time, we will consider engaging with other stakeholders, such as the British Healthcare Trades Association.

When launched, the initial iteration of the solution will replace the paper prescription with a digital solution. We will achieve this by developing an end-to-end digital solution for in-hours prescribing from general practices through to community pharmacy dispensing. Appliance items which are prescribed from in-hours general practice for community pharmacy dispensing, will come under the new process at this time.

If NHS health boards have alternative arrangements in place for appliance prescribing and dispensing, then these may be included in subsequent phases of the programme. Appliances for patients will continue to be prescribed and dispensed during any period of change.

Work is also underway to produce an Equality Impact Assessment which will provide a wide view of how the digital solution will affect people. These findings will be used to ensure that we can mitigate against any challenges or issues in the design of the DPDP digital solution while ensuring that it is inclusive and accessible.

The National Menopause Specialist Network is open to healthcare professionals with a special interest in menopause. The Network currently has over 55 members with representatives from all mainland Health Boards.

The Scottish Government has a long history of providing support for town centre regeneration and continues to provide a strong policy framework, with clear priorities and actions to help facilitate and deliver change. This includes our world leading Town Centre First Principle, which was first developed in Scotland.

Our regeneration strategy published in 2011 reflects our support for town centres as a central part of community life and as the backbone of Scotland’s economy. We further strengthened our ambitions for town centres through the Town Centre Action Plan in 2013 and re-affirmed our commitment in collaboration with COSLA for the Town Centre Action Plan 2 published in April 2022. TCAP 2 is a call to action and sets out some of the ways in which we can all seek to do our part, locally and nationally.

The Scottish Government supports Scotland’s Towns Partnership (STP) as the ‘go to’ body for town centre advice and support. STP works collaboratively with the Scottish Government, local authorities, and other stakeholder groups on engagement, implementation, and delivery of short and long-term town centre strategies.

Town centre regeneration in Scotland has also been backed by multiple investment programmes. Our Place Based Investment Programme (PBIP) established in 2021/22, backed with over £300m over 5 years makes an important contribution to supporting ambitions for place, community regeneration, town centres and 20-minute neighbourhoods. PBIP is also complemented by the low carbon Vacant and Derelict Land Investment Programme (VDLIP) and Regeneration and Capital Grant Fund (RGCF), now in its tenth year. The Scottish Government has received the report from NHS National Services Scotland on the options appraisal process on Mother and Baby Unit provision in Scotland. It is intended to publish the report once those options have been fully considered and next steps determined.
