That the Parliament notes with concern reports that the Active Care Group has moved to derecognise the trade union agreement in place with GMB Scotland at Moorpark Place care home in Kilbirnie, North Ayrshire; further notes the view that Active Care Group has failed to engage with workers or union representatives about these changes; understands that the matter has been referred to the UK Government’s Advisory, Conciliation and Arbitration Service; considers that trade union recognition at care homes is vital to ensuring workers’ rights issues are raised, collective grievances are heard and conditions are improved in the sector; understands that Active Care Group is owned by Montreux Capital Management, an investment firm incorporated in the Cayman Islands; notes with concern data from Registers of Scotland, which reportedly shows that at least 44 Scottish care homes were owned by companies based in tax havens at the end of 2019; believes that the Scottish Government’s proposed National Care Service is an opportunity to reform social care, embed fair work standards in the sector and ensure ethical procurement practices are put in place, and notes the calls on the Scottish Government to include commitments in its national commissioning and procurement structure of standards and processes that state that no care home contract will be awarded to companies that fail to recognise trade unions or apply union-negotiated rates of pay, or that are owned offshore.
