The Civil Contingencies Act (2004) places a statutory duty on responders to cooperate and share information.

There are several technical layers of fallback capabilities in place for communication during circumstances that challenge the usual methods of communication. However, work continues to review current arrangements and ensure they are resilient to a wide range of risks. The existing resilient telecommunications plan for Scotland is currently under review, led by Police Scotland.

As I set out in my statement to Parliament in May, I will begin to take forward a more focused consultation in the autumn on the detail of proposed regulations to restrict the promotion of less healthy food and drink where those are sold to the public. We have begun engaging with stakeholders as part of this process. It is important that engagement on our proposals is extensive and as inclusive as possible.

The overall response landscape in Scotland is set out in our guidance document “Preparing Scotland - Responding to Emergencies”.

A review of this suite of guidance is currently underway. The review, which is being undertaken in consultation with resilience partners, will consider whether the inclusion of additional mechanisms for the coordination of mutual aid should be built into the arrangements.

Bereaved families should not have to wait to receive final confirmation of the cause of death and it is imperative that information about their loved one is provided as soon as possible. As the Lord Advocate noted in her response to S6W-21281, there have been delays in reporting post-mortem results, which is unacceptable. She also recognised that collaborative work has been done to resolve the delays, and that significant progress is expected within the next few weeks.

The Lord Advocate has responsibility for the investigation of all sudden, suspicious, accidental and unexplained deaths in Scotland – including providing bereaved families with the final confirmation of the cause of death of a loved one following receipt of the post mortem report. The Scottish Government does not designate assistance centres or make decisions regarding the pre-positioning of generator capacity.

These issues are rightly for the front line responders, principally Local Authorities, to consider following any emergency. In the Scottish Government's June 2022 update to the Storm Arwen Review, we noted that "All LRPs (principally via Local Authorities) have a wide range of pre-identified rest or assistance centres, with associated arrangements for activation.”

The unprecedented changes by the UK Government reneging on their net zero commitments, including the rolling back of policies already announced and accounted for, have repercussions on our ability to produce a draft Climate Change Plan that is just and fair by the end of November. I am meeting with the UK Government again on 15 November to urge them to reconsider their position, and to stop putting party politics ahead of planetary health.

This, tied with the uncertain economic outlook for the UK as a whole and the constraints of devolution placed upon us, make this challenging task ever more difficult.

The Scottish Government are continuing to develop climate policies and are fully committed to bringing forward a draft of the next Climate Change Plan, covering the period 2025 to 2040, which is fair and just for everyone. It is regrettably not possible to do this by our own November deadline, but will progress in line with statutory deadlines.

The prohibition on pavement parking was brought in with the Transport (Scotland) Act 2019. To support this, a suite of secondary legislation is required to bring this legislation into force. Final enforcement and accounts Regulations were laid in Parliament on 2 October and are due to come into force on 11 December 2023, subject to Parliamentary approval. These Regulations give local authorities the power to enforce the restrictions on pavement parking, double parking and parking at dropped kerbs by issuing Penalty Charge Notices of £100 (reducing to £50 if paid within 14 days).

The Scottish Government has no locus to intervene in this matter. The Scottish Information Commissioner is entirely independent of the Scottish Government. The Scottish Environmental Protection Agency is also a distinct Scottish public authority from the Scottish Government, in terms of the Freedom of Information (Scotland) Act 2002.

Ministers will take decisions about where the funding is allocated in 2024-25 and future years subject to the outcome of the Scottish Budget process and associated approval by the Scottish Parliament.

The draft budget will be published later this year and will be the subject of Parliamentary scrutiny in early 2024. The Scottish Government intends to present the Draft Budget 2024-25 to Parliament on 19 December 2023.

We are aware of the pressures in temporary accommodation that many local authorities, including Fife Council, are facing and are working with them on what support is needed to reduce their use of temporary accommodation. The Minister for Housing is due to meet again with Cllr Hamilton, Fife’s Housing Convenor, on 7 November.

We have committed to reducing the use of temporary accommodation by 2026 and are acting on the recommendations of the expert Temporary Accommodation Task and Finish Group. We will invest at least £60 million for local authorities and social landlords to acquire properties for use as affordable homes, as part of our wider £752 million Affordable Housing Supply Programme investment this year. We are also asking social landlords to increase allocations to homeless households and to bring empty homes and void properties back into use, and are supporting councils to develop targeted plans, supported by an additional £2 million in 2023-24.

The Scottish Government is continuing to meet with the local authorities most under pressure to discuss what is required to help reduce their use of temporary accommodation. The Scottish Government has established a Short Term Housing Supply Group to consider how to address the barriers to increasing housing supply in the short term. We are working with COSLA, ALACHO, the Scottish Housing Regulator, the Scottish Federation of Housing Associations and the Glasgow West of Scotland Forum of Housing Associations to consider what we need to do differently in the next two to three years to reduce the use of temporary accommodation.
