The Bail and Release from Custody (Scotland) Act 2023 introduced the ability for the Scottish Ministers to instruct the early release of specified groups of prisoners where is it "necessary and proportionate" to do so in response to the effects an emergency situation is having or is likely to have on a prison or prisons generally, to protect the security and good order of prisons, or to protect the safety and wellbeing of prisoners and staff.

This allows the Scottish Ministers to take action that would support the safe operation of our prison system during an emergency, and to protect the safety of prison staff and prisoners. This would never be an action that we would take lightly, and the emergency early release power would only be used if it was considered absolutely necessary and proportionate to do so, in line with the legislation.

The Victim Notification Scheme is the means by which victims can indicate that they wish to be informed of information regarding the release of a specific prisoner.

The Chief Executive of the National Social Work Agency is a Senior Civil Service (SCS) post and SCS pay and terms and conditions of employment are reserved to the UK Government. The advertising process for this role ended prior to the announcement of the recently publicised SCS pay award. Therefore, this role was advertised with a salary range of £108,393 to £117,329.

Following completion of the interview stage, the successful candidate will be offered the role in line with the updated pay range effective from 1 April 2025, which is £111,916 to £121,143. This salary range is within the relevant SCS2 pay range of £100,000 to £162,500 published by the Cabinet Office.

The fiscal regime for offshore oil and gas, as well as the regulatory regimes for licensing and consenting, are all matters that are currently reserved to the UK Government.

We continue to call on the UK Government to listen carefully to concerns being expressed by businesses and trade bodies around the impacts of its Energy Profits Levy.

We are now awaiting the UK Government’s response to its recent consultation, which must clearly set out how a stable and long-term fiscal regime will be used to deliver business and investor certainty for the North Sea. The Energy Profits Levy was always supposed to be a temporary measure and we must see the earliest possible end date, as it is now affecting investment and jobs in the North East.

The establishment of the National Social Work Agency is underway. It will be an Executive Agency of the Scottish Government and will be established by Spring 2026. Recruitment for the Chief Executive of the agency is underway to support the transition from the Scottish Government and is line with existing policies and procedures.

The Scottish Government’s hybrid working policy outlines that organisations outside of Scottish Government core, for example, executive agencies will set out their own local approaches. Once the Chief Executive is in post and with the supporting structures in place, the future policy on hybrid working within the National Social Work Agency will be a matter for the Chief Executive and the Board to lead, in consultation with staff and the unions.

It is unclear where the figure for the reported loss of 12,000 homes from the landlord register since May 2023 has come from. The most recently published figures show an increase in registered properties of almost 8,000 from May 2023 to July 2025.

According to official published statistics derived from the Scottish Landlord Register, in May 2023 there were 238,787 registered landlords and 341,417 registered properties. By July 2025, the most recent data available, this had fallen to 232,922 landlords, while the number of registered properties had increased to 349,313:

This represents a reduction of 5,865 landlords over the period. Importantly, while landlord numbers have declined slightly, the number of registered properties has risen by almost 8,000 homes.

While these changes may point to some landlords choosing to leave the sector, the evidence suggests that their properties are remaining in the sector, or new properties are being offered for rent.

It should be noted that there are some limitations to the administrative data from the landlord register, including the time-lag in landlords deregistering properties that are no longer available to rent. These statistics should therefore be treated with some caution.

Scottish Government Ministers and officials engage with UK Government, including HMT Treasury counterparts and a wide range of stakeholders when considering all of these issues and will continue to do so.

The Scottish Government continues to progress a range of actions in collaboration with justice partners to support a sustainable reduction in the prison population, whilst maintaining a focus on protecting the public.

At present, Community Payback Orders (CPOs) are the most commonly used alternative to a custodial sentence, with over 15,100 commenced in 2023-24. CPOs are a flexible and robust disposal which make people pay back to their community and can include one or more of a range of requirements which can be tailored to fit the circumstances of individual cases (including unpaid work, supervision by justice social work, and addressing addiction issues). The evidence shows that community-based interventions and sentences can be more effective in addressing offending behaviour and assisting with rehabilitation than short-term custodial sentences, leading to fewer victims and safer communities.

We have increased community justice funding by £25 million over two years, bringing the total to £159 million in 2025-26. This has increased the use of alternatives to custody and supports a range of community justice services, including diversion from prosecution, alternatives to remand and community sentencing.

Looking ahead, we have also established an independent Sentencing and Penal Policy Commission, with final recommendations to be presented to the Scottish Government by the end of this year to help ensure that Scotland has a sustainable prison population over the longer term. This important work will consider how imprisonment and community-based interventions are currently used and what improvements can be made in dealing with offending behaviour in an effective and proportionate manner.

The provision and procurement of police uniform and equipment for officers is a matter for Police Scotland and the Chief Constable. I am clear that police officers and staff should be provided with the correct tools for the job.

Our record £1.64 billion investment in policing is helping equip officers with modern tools like body worn video, ensuring they have the right resources to keep communities safe.

There are currently no plans to introduce direct dermatology referral pathways from community optometry and pharmacy.

Our Digital Dermatology programme has provided GPs across Scotland with access to a new app which allows them to securely use their own mobile device to attach an image to a dermatology referral. This has the potential to significantly reduce the dermatology waiting list by diverting 50% of patients each year either back to their GP with advice or direct to treatment through the creation of a digital triage process in secondary care.
