Keith Brown: I have asked Teresa Medhurst, Interim Chief Executive of the Scottish Prison Service (SPS), to respond. Her response is as follows:

SPS is currently preparing a new Health & Wellbeing Strategy to address health inequality among prisoners. The Strategy is being drafted to align with the development of the SPS 2023-2025 Corporate Plan.

Many remote and rural communities in Scotland are hugely impacted by wildfire incidents, which can also cause significant environmental and economic damage. This is something the Scottish Fire and Rescue Service (SFRS) is very aware of, and it works closely with key partners, including land managers and communities, to establish a common understanding of the risks, prevention measures and response procedures. SFRS has produced a wildfire strategy with partnership at its heart, that will ensure that personnel are equipped and trained to deal with these emergency risks and that the Service’s delivery model has sufficient resilience and flexibility to support wildfire incidents occurring over extended geographies and timescales – ensuring the right resources in the right place at the right time to fight wildfires. This not only provides a framework for wildfire response but also a strong platform for preventative work including a joined-up approach to land management including the use of Muirburn and prescribed burning but also wildfire mitigation in planning stages for new forest plantations.

The Scottish Government’s Fire and Rescue Framework for Scotland 2022, launched in the spring this year, asks SFRS to continue to invest in the provision of specialist resources, technological advancements and forward thinking operational practices to enhance its response to wildfire events. It states that SFRS should continue to make use of local assets available to bolster its response during prolonged or widespread incidents such as wildfire.

We are already seeing warming here in Scotland, with more extreme weather events and rising sea levels. As a nation we must adapt to these changes and prepare for the impacts of global climate change which are already locked in. The Scottish Government is responding to the full range of climate risks identified for Scotland through its 2019 Adaptation Programme, which sets out more than 170 policies and proposals to build resilience to the impacts of global climate change.

The specifics of the Islands Bond are still being carefully considered in light of the strong feedback we have received from island residents, and within the new context of the current energy crisis and rising living costs which are being experienced by many islanders.

In response to this, details setting out the direction of travel for the policy will be announced later this summer.

Identifying the number of individuals monitored electronically in each year is not possible from the data held without significant further analysis to remove from the data, those individuals who may have received multiple orders and licences over the period.

However the number of installations onto electronic monitoring made each year (with the caveats below) is a reasonable proxy for monitored individuals.

An installation is the action to fit a monitoring tag, irrespective of the licence or order monitored. While most electronically monitored individuals will be installed on an order or licence only once in a year, the same individual may have more than one installation in the course of a year, for example, if they have a subsequent new order or licence in that time period.

The impact of COVID-19 has been felt across all services within the justice system including within courts and prisons. During the financial year 2019-20 the number of installations of those electronically monitored (court orders and licences) was 4030, however the number then significantly dropped during the periods of COVID-19 disruption.

The numbers of those currently monitored are continuing to rise and we are now once again approaching some of the highest levels of monitoring we have seen.

The second part of the question asks for a breakdown by local authority area. This information is not currently held (although breakdown by issuing court area for example is possible). However a recent systems change from June 2022 means this breakdown by local authority area will be possible in future years.

Our Equally Safe Strategy for preventing and eradicating violence against women and girls emphasises the importance of challenging the underpinning attitudes which enable such violence to take place. Education settings have an important role in challenging these attitudes through teaching children and young adults about healthy relationships, consent and gender stereotypes which drive gender-based violence.

Our Equally Safe at School (ESAS) project, developed by Rape Crisis Scotland and Zero Tolerance, applies a whole school approach to inequality and gender-based violence in schools. Rape Crisis Scotland have reported that 3 schools in the Glasgow region are currently registered for an ESAS account. This year, Rape Crisis Scotland anticipate the number of schools registered for ESAS will grow as they continue to focus on the promotion of ESAS and work both nationally and with local authorities to develop ESAS implementation strategies.

The Scottish Government also funds and supports other education-based programmes and initiatives aimed at preventing gender-based violence such as our Mentors in Violence peer education programme, the Gender Equality Taskforce in Education and Learning, the Gender-Based Violence in Schools Working Group and Rape Crisis Scotland’s national sexual violence programme for secondary schools

The Scottish Government is opposed to the use of mosquito anti-loitering devices and does not believe the use of these devices is consistent with our approach to tackling antisocial behaviour which seeks to promote strong and supportive communities where the rights of individuals are recognised and respected.

We believe the Antisocial Behaviour etc. (Scotland) Act 2004 currently provides sufficient measures to help police and local authorities deal with antisocial behaviour wherever it arises.

We take young people’s complaints and safeguarding of their rights seriously and understand the Children and Young People’s Commissioner Scotland’s concerns on the use of mosquito devices and young people’s rights and have taken action which is within our current powers to minimise the impact that these devices have on children and young people. This has included contacting the main public sector bodies to discourage the use of these devices on their estates. Use of these devices appears to be very limited in Scotland. We understand that none of the main public sector bodies use them on their sites and, last year, Police Scotland advised that they were not aware of them being used in any premises across the country.

We have additionally lobbied the UK Government to take action on these devices – but there appears to be no current UK action planned to regulate, license or otherwise prevent the sale of anti-loitering devices.

This uplift in the minimum hourly rate of pay for adult social care workers, delivering direct care, is being delivered through Local Government contracts and funding to deliver this took effect from 1 April 2022; with the Scottish Government transferring £200 million to Local Government to support investment in social care, including to deliver the £10.50 minimum hourly rate for these workers.

The Scottish Government and COSLA have set up mechanisms, through discussions with the Fair Work in Social Care Group, to establish and address any issues or exceptional delays in relation to delivering the funding for the uplift to providers and subsequently eligible workers.

We have regular communications with Scottish Care, the Coalition of Care and Support Providers Scotland (CCPS) and Trade Union representatives to discuss any concerns or questions around implementation of the uplift and have worked together to resolve these quickly. Through this process to date, we have not had any examples brought to our attention of private care providers not paying the £10.50 minimum hourly rate.

However, despite the apparently good levels of compliance, we are currently working with key stakeholders to establish a webpage with details for members of the adult social care workforce to make contact with local commissioning teams directly if they are not receiving the £10.50 per hour rate so this can be investigated.

The Scottish Government also encourages and receives communications from members of the workforce directly. To date, we have received one case where members of the workforce are not receiving £10.50 and this is currently being looked into.
