The First Report of the independent review of incineration was delivered in April 2022. Having accepted all of its recommendations, we have already taken actions to deliver the commitments we set out in our response. This includes introducing new restrictions on the development of energy from waste proposals in National Planning Framework 4, and working with UK Government to develop a methodology to report emissions from energy from waste separately.

Following careful consideration of the key findings and recommendations of Dr Church’s Second Report, we have published our response to the Report today. Our response accepts, in full or in principle, all of the report’s recommendations and sets out the actions we are taking to decarbonise the waste sector, in particular by ending the unnecessary incineration of plastics.

Our 2022 Waste & Circular Economy Route Map consultation set out a range of proposed measures that will support the ambition to end the unnecessary incineration of plastics. These include continuing to deliver the £70 million Recycling Improvement Fund, implementation of extended producer responsibility (EPR) schemes, and greater transparency in the end destination of recycling collected. In addition, we will continue to work with other governments of the UK to consider the expansion of the UK Emissions Trading Scheme, which the Report notes could be an important decarbonisation tool.

We are also continuing to incentivise and support the deployment of combined heat and power, including for incineration facilities through our £300 million Heat Networks Fund. This is available across this Parliamentary session to support the rollout of new zero emission heat networks and communal heating systems, as well as the expansion and decarbonisation of existing heat networks across Scotland. Further details on implementing these recommendations will be incorporated into the final waste Route Map.

Special Advisers are appointed in accordance with Part 1 of the Constitutional Reform and Governance Act 2010 by the First Minister as a Special Adviser for the purpose of providing assistance to the Scottish Ministers.

The total cost of Special Advisers employed during the financial year 2020-21 was £1,618,713.47. Total cost includes all salary costs, employer NI, and employer pension contributions. The level of employer NI and pension contribution is not a matter for the Scottish Government.

The Scottish Government published a series of refreshed GIRFEC policy and practice guidance to provide practitioners and professionals working with children, young people and their families with the confidence, clarity and practical support to continue to embed the GIRFEC approach.

The Regulation of Legal Services (Scotland) Bill was introduced to the Scottish Parliament on the 20 April 2023. Information about the Bill can be found on the Scottish Parliament website here .

The powers of the Law Society of Scotland are already well established in legislation, within the Solicitors (Scotland) Act 1980 and the provisions of the Bill are intended to improve and modernise their regulatory function.

The Bill will provide for a modern regulatory framework designed to promote competition and innovation while also improving the transparency and accountability of legal services regulation and the legal complaints system in Scotland.

The Bill introduces a modern set of regulatory objectives and professional principles, while incorporating key aspects of the Better Regulation, the Consumer Principles and the Human Rights (PANEL) Principles, that legal services regulators will require to adhere to. The Bill contains provisions setting out how the independent regulatory committee of the Law Society of Scotland should operate, intended to increase transparency and accountability of legal services regulation. The Bill also introduces provisions about how certain businesses that provide legal services should be regulated, introducing entity regulation and with it stronger protections for consumers, intended to complement existing regulation rather than introduce duplication.

The Bill is designed to take a proportionate approach that seeks to balance and deliver the key priorities of all stakeholders. The Scottish Government has committed to continue to work collaboratively with stakeholders in respect of this reform, and throughout the parliamentary passage of the Bill.

The Scottish Government supports and funds the creation and restoration of hedgerows in Scotland through the Nature Restoration Fund (NRF) and the Agri Environment Climate Scheme (AECS).

A breakdown of the total miles of hedgerows reinstated and planted through NRF is not routinely collected and any information about hedgerows is gathered under a more general ‘habitat’ metric, therefore this data cannot be provided.

The total miles of hedgerow that have been reinstated and planted through AECS, in each year, is set out in the following table. There was no hedgerow creation in 2022 as the restricted round in 2021 did not include the hedgerow options.

The Deposit and Return Scheme for Scotland Regulations 2020 set out the definition of “scheme article” at regulation 3(2). That definition does not assign any minimum set value to scheme articles, nor does it make any provision about them being a distinct class of commercial product.

The Scottish Government requests annual data on overall Young Patient Family Fund claims from territorial Health Boards and this allows uptake and cost within each Board area to be tracked year-on-year. This includes detail on the type of claim being made.

We do not ask Health Boards to routinely collect data on patient condition as this is not part of the eligibility criteria for making a claim. Similarly, Health Boards are not asked to report on the age of the patient. As part of our routine monitoring we do however ask Health Boards to report on the number of young inpatients associated with claims who were admitted to neo-natal units.

The Scottish Government are aware that there have been continuing shortages across the UK due to a number of factors. The supply of medicines, including HRT products and the associated legislation, is a reserved matter for the UK Government. We continue to engage with the Department for Health and Social Care (DHSC) to seek a lasting solution.

A series of UK-wide Serious Shortage Protocols (SSPs) have been issued by DHSC, after consultation with the Scottish Government and other UK administrations, allowing community pharmacists to supply specific alternatives without needing to seek agreement from the prescribing doctor. An SSP is an additional tool to manage and mitigate medication shortages. This gives individuals the option to receive substitute products in a safe and effective way to ensure medication continues to be available to all.

There are over 70 HRT products available in the UK and supply issues are affecting only a small number of them.

As part of the Green Freeports bidding process, bidders were required to outline how their choice of tax site locations would minimise displacement of economic activity from wider areas, especially other economically disadvantaged areas. This was given close consideration within the assessment process. The successful bidders – Firth of Forth, and Inverness and Cromarty Firth – will now develop their initial proposals into detailed outline and full business cases.

Scottish Government officials provided feedback to the unsuccessful bidders and confirmed that the Scottish Government stood ready to work with the bidding coalitions to consider whether and how it might be possible to build on aspects of their plans, outside the Green Freeports programme, to deliver jobs and growth in their respective regions.

The two selected Green Freeports will build on specific areas of strength and opportunities in their particular locations, so we are optimistic that the immediate risk of displacement will in practice be limited. They will be required to monitor, mitigate and report on any potential displacement as they move forward to delivery.

Circularity Scotland is developing and constructing the logistical network that will support the effective operation of the scheme when it launches on 1 March 2024, and it has signed contracts with Biffa for operations, logistics, and plastics reprocessing. It has secured a number of sites across Scotland to deliver the scheme, including sites in Aberdeen and Motherwell, creating up to 200 jobs.
