Subordinate Legislation

The Convener:

Item 4 on the agenda is subordinate legislation. Before us today is statutory instrument 2000/1113, the Scotland Act 1998 (Cross Border Public Authorities) (British Wool Marketing Board) Order 2000. As a statutory instrument covering a cross-border public authority, the SI has been laid before the Scottish Parliament and Westminster. A note from the Scottish Executive is attached with the SI, and a note from the clerks. No officials have been asked to attend to speak to this SI. The last page of the Executive's note sums up the situation. The order resolves a doubt about how functions should be exercised; it determines that they should be exercised by UK ministers acting with the consent of Scottish ministers, rather than by ministers acting jointly. Are there any comments on this order and the accompanying notes?
