Item 4 on the agenda is subordinate legislation. Before us today is statutory instrument 2000/1113, the Scotland Act 1998 (Cross Border Public Authorities) (British Wool Marketing Board) Order 2000. As a statutory instrument covering a cross-border public authority, the SI has been laid before the Scottish Parliament and Westminster. A note from the Scottish Executive is attached with the SI, and a note from the clerks. No officials have been asked to attend to speak to this SI. The last page of the Executive's note sums up the situation. The order resolves a doubt about how functions should be exercised; it determines that they should be exercised by UK ministers acting with the consent of Scottish ministers, rather than by ministers acting jointly.
