Scottish Government Responses

I welcome members to the eighth meeting in 2008 of the Subordinate Legislation Committee. We have apologies from John Park. I ask everyone to turn off their mobile phones and BlackBerrys.

After our meeting on 26 February, we wrote to the Scottish Government about six Scottish statutory instruments; we have seen the Government's responses.

Are we content with the Scottish Government's responses and, if so, are we content to draw the instruments to the attention of the lead committee and Parliament?

Adult Support and Protection (Scotland) Act 2007 (Commencement No 2 and Transitional Provisions) Order 2008 <br />(SSI 2008/49)

The Convener:

Are we content to draw the order to the attention of the Parliament on the grounds that the meaning of article 2(2) of the order, in so far as it brings into force section 74 of the enabling act, could have been clearer; and that the Scottish Government intends to introduce an amending order to clarify the matter prior to 1 April 2008?

Water Environment (Diffuse Pollution) (Scotland) Regulations 2008 (SSI 2008/54)

Are we content to draw the regulations to the attention of the Parliament and the lead committee on the grounds that a response, with which we are partially satisfied, was sought from and provided by the Scottish Government?
