Many of the existing legal requirements and exemptions that are applied to public service pension schemes refer to schemes constituted by Westminster legislation. Following the bill, the rules of our scheme will be contained in an act of the Scottish Parliament, rather than, as for the existing scheme, in a Westminster instrument.

The last two paragraphs in part B deal with commutation of pension for lump sum following death in service. It is now possible to include an option for the spouse or civil partner to commute part of the pension payable for a lump sum when a member dies in service.
