We do not necessarily agree that the offences are unclear.As for the reasonable excuse defence, we had to weigh up which penalty was appropriate to each offence. The general guidance that we follow is to use strict liability only for more serious offences.

One of the problems in East Ayrshire is that the authority has gone straight to proposing schools for closure and views the consultation as a statutory one. Instead, it could have followed a different model by taking an overview of what is required of the whole school estate and engaging and consulting parents on that.

To its discredit, the SNP has tamely followed suit. Does the member not accept that those who participated in the pilot projects stood to lose the most if the proposed scheme went ahead, which is why the pilot projects did not work?

Do you have any evidence that would be of use to members of the committee? We will have to follow up on that. I took the view that the Young Scot card entitlement scheme, or whatever it is called, can be beefed up at minimal cost, but I need to get some figures on that—I will pursue it.
