We broadly agree with the interpretation taken by EHRC, that the protected characteristic of “sex” takes into account when a full GRC is obtained. It’s helpful for EHRC to provide clarity on this, however this distinction and debate relates to interpretation of the Equality Act as it currently stands, not to the effect of the Bill.
