The 2008 order provides that “Wholly Scottish devolved statistics produced ... by the persons listed in the Schedule are specified as official statistics for the purposes of ... the Statistics and Registration Service Act 2007.” Listed persons are bound by the code of practice for official statistics and how they are published.
Our report highlights huge inconsistencies in those two codes. GP referral for admission is a new code to the datamart over the past 18 months or so, but that is why we made a recommendation about the Scottish Government sharing good practice on that process and on the way in which patients are referred to A and E.
The willingness of Lord Smith, as chair of the group that drew up the code, to listen to views for improvement and to consult is welcome.However, it is obvious that a new code cannot implement all of the review recommendations.

He would almost certainly need to go to the civil service code rather than to his contract because we do not write the whole civil service code into people's contracts, but he would be aware at that point that he was subject to the civil service code.

It is a long-established convention, as set out in the Ministerial Code, that the Scottish Government does not disclose whether it has or has not received legal advice from the Law Officers.
