Let me read out what the ministerial code of conduct says: “It is of paramount importance that Ministers give accurate and truthful information to the Parliament, correcting any inadvertent error at the earliest opportunity.”
The key thing is that any framework, whether it be statutory or a non-statutory code of practice has to be developed in conjunction with all key players.
It is a long-established convention, as set out in the Ministerial Code, that the Scottish Government does not disclose whether it has or has not received legal advice from the Law Officers.
There is probably only one novel part, which is the reference to the new rules requiring codes of construction practice and noise and vibration policies to be mandatory documents that accompany bills.
He would almost certainly need to go to the civil service code rather than to his contract because we do not write the whole civil service code into people's contracts, but he would be aware at that point that he was subject to the civil service code.
