We do not accept that there is any circularity in those powers.The Subordinate Legislation Committee's 33rd report states:"Paragraph 9 obliges any applicant, or any employee or agent of any applicant, to give to an authorised officer such assistance as that officer may reasonably request in order for that officer to exercise the powers conferred by paragraph 10 … Accordingly, should there be reason to suspect that an applicant failed to comply with a reasonable request from an officer for such assistance",the officer may"exercise any of the powers under paragraph 10 to ascertain whether … the applicant failed to comply with the obligation imposed by paragraph 9."
