Paragraphs 2(2), 4(2) and 3(1)(b) of schedule 1 to the Education (Additional Support for Learning) (Scotland) Act 2004—the enabling act—provide that the convener of a tribunal should be a tribunal member and that the president may be a member, and the definition of tribunal member in paragraph 1 does not distinguish between conveners and other members.
