Nothing in the provisions authorises the making of a disclosure that contravenes the Data Protection Act 1998 or that is prohibited by part I of the Regulation of Investigatory Powers Act 2000.Secondly, the order adds two further functions to the list set out in section 441 of the Proceeds of Crime Act 2002, in respect of which Scottish ministers and the Lord Advocate may disclose information to others. Those relate to protecting public health and the functions of the Financial Services Authority under the Financial Services and Markets Act 2000.
