The amendment will ensure that the permissions granted by section 16 to discharge water will be subject to regulations relating to controlled activities made under the 2003 act. Controlled activities must be authorised by the Scottish Environment Protection Agency in advance of their being carried out.Amendment 36 clarifies that, in relation to specified works close to or on water, the Water Environment (Controlled Activities) (Scotland) Regulations 2005 will continue to apply.
