At the very least, we must have a statement to the Parliament to get the matter set right. It is good that Lord James has raised this debate, because—as others have said—the vote is fundamental to democracy and if votes are not counted, that makes a mockery of the whole process.

I have made clear my view that there is a key UK-wide constitutional jurisdiction in relation to devolution issues, including those that relate to the ECHR. It would be actively wrong to build in an automatic Scottish majority in cases in which there is a legitimate UK-wide interest in the outcome.
