In its letter to the Presiding Officer, which can also be read in the Annex, the Scottish Government explained that it was unable to lay the instrument in late June to allow the full 28 laying days before coming into force.
It should be holding the public services to account and politicians should be holding the Government to account to ensure that those public services are held to account.
The Scottish Government continues to aim to allow 10 to 14 calendar days between the date of laying and the coming into force of instruments of this type, to allow for scrutiny and adjustment by those affected by a change in the law.
As is usual for commencement regulations, the default laying requirement applies (as provided for by section 30(2) of the Interpretation and Legislative Reform (Scotland) Act 2010).
However, my officials have identified no policy concerns with the draft SI. Intended laying date (if known) of instruments likely to arise The instrument is expected to be laid on 4 November 2024.
