However, the bill will restrict a large number of people from entering the field, although it will still be possible to build up a new activity that would be commercial by any other standards, except for the primary care eligibility criterion for directors. It is common sense that the commission should have discretion, given the example that you gave involving a de minimis offence, but if somebody applies to register and they are refused on the basis of that discretion will there be an appeal procedure?

My hunch would be that a charge that could be regarded as having a level of impact that could be described as de minimis—that is, a minute impact on a minute proportion of the population—would not satisfy the terms of the charter but that something towards the other end of the scale might begin to, perhaps along with other charges.
