The disclosure rule in the Code of Conduct (at Section 9, paragraph 1) states:
“Members must not disclose, communicate or discuss any complaint or intention to make a complaint to or with members of the press or other media prior to the lodging of the complaint or during Stages 1 and 2 of the procedure for dealing with complaints (this procedure is set out in the guidance on the Code of Conduct (the Code)).”

The Background section on page 2 of the draft Code states:
“…The draft Code was prepared by the Electoral Commission (the ‘Commission’) in accordance with [section] 100BA PPERA following consultation with, interested persons, the Scottish Parli...
We believe that where the Cabinet Secretary’s submission states "We are now in receipt of ..." implies the paper is new, rather than work the Scottish Government have failed to act on for four years.
