We had that debate at stage 1, as Mary Scanlon rightly remembers. The committee should remember that it will be up to HES to decide whether it wants to apply to be a charity and, if it does, it will be up to OSCR to determine whether it passes the independence test that Mary Scanlon rightly identified.
