To that end, regulation 25 of the Disability Assistance for Working Age People (Scotland) Regulations 2022, places limitations upon the mobility component that a client in receipt of Adult Disability Payment can receive once they have reached the relevant age, such that they will not be able to become entitled to that component at a higher rate than they have already been receiving for a pre-existing condition, and may only continue to receive that rate where it results from substantially the same condition or conditions in respect of which it was previously received.
