Obviously, as Bill Butler said, if there is some uncertainty surrounding the draft bill, both the petitioners and the member who has a constituency interest in the matter may resubmit an amended petition. If the Government is going out to consultation, perhaps we should ask it to ensure that the petitioner is consulted.

Even if Captain Carter's petition refers to a reserved area of law, it abuts areas of law that are not reserved. The petition may therefore be admissible, simply because it is not entirely unrelated to Scottish law, which, of course, comes under our responsibilities.

That is a law reform that no previous Administration sought to introduce; indeed, there may be problems in introducing it. In any event, given that any law reform would not be retrospective, it would not apply to those who have difficulties with land maintenance companies.

As Keith Brown said, we have discussed whether Scotland's interests are being fully represented, but the issues that we came across last session were the transparency of that representation, the status of the memorandum of understanding and to what extent the Scottish Government or anybody else is able to state openly what position it has argued for and how that may differ from the UK Government's position.Another possibility for us, apart from making a written submission, is to have an informal session with the Scottish Affairs Committee to discuss some of these matters.

A second issue is that I am unsure—to put it mildly—whether the people who implement the guidelines are aware of the Government's view. The Government may well say that there is no anomaly, but I can tell you that telephone companies and local authorities do not act as if they know that the guidelines also apply to pre-school children.
